, ISeetioti 1, Tse it ordained by the Board of _Tkiistees of Uni Town of Kensselaer, Indiair.v, in legal session, _tlia.t. a -sewer -be~cotXN“ stfneted An the following route,-to-wit: com lueiieiMg hear the southerly Hile df Angelica Street in said town at a suitable distance from said line and at a point directly opposite to the northerly corner of lot seven (71 in block eight (8) iii said town, and running, thence in a westerly direction alongL tire-the soirtimtd^-sidetrf sirnt street to the easterly side of Front street; thence across Angelica-street to a point near the northerly side thereof; thence in a westerly direction along the northerly side of said street and cont inued in the same line to the Irottnois river, where said drain will terminate Section 2. The sewer provided for in section 1 of this ordinance shall be constructed of tile ten (10) inches in diameter, laid on boards at a depth of not less tW five (5) feet at the point of commencement named and to be constructed under the provisions of an act of the Indiana Legislature of March Bth, 1889 as set forth in the acts of said sessions on pages 237 to 2i > inclusive. (See seev tion 2 thereof:) Section 3. James F. Irwin, Marlon L. Spitler and George 11. Brown, freeholders and voters of said town and not in any way interested in said sewer, are hereby appointed appraisers whose duty it shall be to examine all the lots and parts of lots in said town or other pieces or parcels of land that will in anv manner oebenefltted by the construct ion of said sewer and to assess the amount of benefits to each lot or nart of lot or other piece or parcel of land that will re--atilt ithereto’by the construction of said sewer, to make out a schedule of said lots and other pieces or parcels of land With their assessments thereto. To append to said schedule and assessments their affidavits that their said assessments are in all respects true and impartial assessments of the benefits resulting to each lot, part of a lot and other piece or parcel of land in any way benefltted by the said proposed sewer, and to file said schedule and assessment with the Clerk of the Board of Trustees of said town who shall record the same: in the records of said town. Should any person apitdihted as appraiser fail to act, or should a vacancy in any manner occur in the appraisers now or hereafter appointed their pieces may be filled by the board of trustees at any regular or special meeting of said Board. Section 4. James C. T hrawles is hereby appointed engineer to lay out and make plans and specifications for the construe, tion of said sewer and John R. Vrtnatta and Ed. H. Morlan are hereby appointed agents to purchase material and superintend the construction of said work. Sectioii 5.
