After hearing the counsel of the different interests represented in the suit for the foreclosure of the mortgages ou the -Chicago and threat Southern railway l..st week, it was decided by JudgesGiesham and Woods to grant a decree ordering the sale—of t lie property. The decree provides that the claims for labor and material used m the improvement of the road, amount ! ing in the aggregate to about, £2OO, 0(H), shall be paid first from the, j proceeds of the sale, and the debts j contracted by the receiver, umonut- j ing to $153,000 more, shall next be. : paid, while out of the remaining tuuds the bonds held by the Purer syndicate, which s mounted to *1,200,000, shall be paid. Those •bonds were issued while the road was under the exclusive control of ! Henry Crawford, and were sold by him to Drexel, Morgan <!fc Co., of ■New York, who subsequently dis r posed of them to the Porter syndicate for $500,000, after \ Mr. ’ Crawford wasjanable to meet his i .Alligations to them.' Under the circumstances, the court holds i ;hat the claims for labor and the debts contracted bv the receiver ’ should be paid before the, bondholders receive anything. The court lin» fixed $500,000 as the i minimum amount for which ; the property shall i>p sold, as th:s sum required -to cover the claims That must t*e paid and the -court expenses.
