CIRCUIT COURT NOTES.
Jury Falls to Agree In the Wempe Case—Notes. The February term of the Jasper circuit court came to a close last Saturday. The trial of Edward Wempe on the charge of obtaining money under false pretenses occupied considerable attention and resulted in a disagreement of the jury. Frank Foltz appeared for Wempe and Prosecutor Sink and his deputy, R. W. Marshall, prosecuted the care. Wempe asked for a continuance of the case until the next term of oourt on the grounds that he bad not been able to obtain certain depositions. His application was denied and the trial proceeded. From the evidence it appeared that Wempe had at one time been employed by the Louisville liquor house but had been discharged by telegraph, and that at the time he drew the sight draft here he was not in their employ. On many points the evidence was not clear, which no doubt accounted for the disagreement of the jury. At the next trial of the case the state hopes to have witnesses here from other points that will materially strengthen their case. Warrants are in the sheriff's hands from other points for the arrest of Wempe, and If he Is finally acquitted here he will be turned over to an officer from one of the towns where he is wanted. Mrs. Amelia Debo, of Remington, was on Thursday granted a divorce from her husband, Jesse Debo, on the charge of abandonment. Her maiden name is restored and she is forbidden to marry again for two years. John Mohler was tried by a jury on the charge of assault and battery upon bis brother-in-law, Gilbert Nestle, out in Jordan township. The verdict was “not guilty.” In the case of Rev. Jacob Dyke against the Presbyterian church of * ave » verdict of |360. Rev. Dyke served as pastor for one year, and claimed to have been employed for another year, but after serving a few months of the second year, he was discharged and brought suit for the balance of the year’s salary, with the above result.
