Constable Acquitted.

Constable Fish Gilmore, of Fair Oaks, was tried before a jury in Squire Troxeii’s court last Saturday for neglect of duty and acquitted. Last July a Newton county citizen named Dewey shot a prairie chicken in Jasper county. A warrant was sworn out for Dewey in Squire Fa>’s court at Parr, and given to Gilmore to serve. It is claimed that the constable failed to serve the warrant and Dewey had some of his friends swear out a warrant in Newton county against him on the same charge, and the court having no jurisdiction there he was acquitted. This barred the prosecution of Dewey in Jasper county, as he could not be tried twice for the same offense.
