Millor, Surveyor of Jasper Co. 82-8 SHERIFF’S SALE.—By virtue of a copy of decree and execution to me directed from the clerk of the Jusper circuit court, 1 will expose at public sale to the highest bidder on Saturday, the 13th day of May, 1878, between the hours of 10 o'clock a. m. and 4 o’clock p. m. of said dr.y, at the door us the oourt bouse of Jasper county,, the rents and profits for a term of not exceeding seven years, of the following described real estate, to-wit: The east half of the northwest quarter of section twenty-three (28), in township thir-ty-two (82) north, of range seven (7) west; and ths four (4) acres, commencing at the southwest corner of the southwest quarter of the northeast quarter of the said section twenty-three (23), thence sixteen (16) rods oast, thence north forty (40) rods, thence' west sjxteen (16) rods, thence south forty (40) rods, to the place of beginning, all in section twenty-three (23), in township thir-ty-two (82) north, of range seven (7) west, containing in all eighty-four (84) acres, in Jasper county, Indiana; and on failure to realize the full amount of judgment, interest and costs, I will at the same time andr place expose at public sale the fee simple of said real estate. ORDINANCE NO. 4 0.-An Ordinance concerning License to exhibit any Caravan Menagerie, Circus , Rope and Wire Daneinn _ uppet Show, Legerdemain, Ventriloquism, Concert, Theatrical Performance a*' any other exhibition. . Suction 1. Be it ordained by the Board of Trustees, of the Town of Rensselaer, Indiana, That it shall bo unlawfnl, for any porson or persons, to exhibit for pay, within the corporate limits of the Town of Renssalaor, Indiana, any Caravan, Menagerie, or Circus without first procuring from the Board of Town Trustees, if said Board be in session, and if said Board be not in session, then from the Town Marshal of said Town a license which shall entitle such person or persons to Exhibit such Caravan Menagerie, or Circus within the corporate limits of said Town. Section 2. Be it further ordained by the Board of Town Trustees of said Town that before any such license shall issue to any such peison or persons, desiring to ex-, hibit for pay any such Caravan Menagerie, or Circus such person or persons shall pay to the Treasurer of said Town the sum of Twenty dollars (S2O) ns a license fee, for each separate Exhibition of such, Catavan Menagerie, or Circus, and the person or persons so paying said license fee, shall take from said Treasurer duplicate receipts, stating in each the amount paid, aud the purpose for which said amount was paid, one of which said receipts, he or they shall deliver to the said Bourn of Town Trustees if they be in session; if said Beard of Town Trustees be not in session, then said person or persons shall deliver said receipt to the town Marshal of su : (l Town, and upon the presentation of said receipt to the Board of Town Trustees said Board shall cause to be issued a license to said pe-son or person, "equesting the same signed by the President of the Board of Trustees, and attested bv the Clerk of the said Board, and upon the presentation of the receipt as aforesaid to the Town Marshal of said Town, he shall thereupon issue or cause to a license as aforesaid, signed by said Marshal, and attested by the Clerk of the Board of town Trustees. Sections. Be it fuuher ordained, by the Board of Town Trustees of said Towu, That any person or persons, or any traveling troupe, desiring to exhibit for pay any rope or wive dancing, puppet show, legerdemain, ventriloqussm, concert, theatrical performance, or any oilier exhibition of whatever name or nalure, before giving aav such exhibition shall pay to the Treasurer of said Town of Rensselaer the sum of five dollars ($5) for each seporate exhibition, and shah take from said Ttcosureties j&ceipt in duplicate, stating tkeieinlUe amount paid and for 'whot purpose puid, one of which said receipts said person or persons or traveling troupe shall doposit with the board of Town Trustees, if they be la session, whereupon said Boa -d shall cause to be issued a license to said person or pe sons, signed by the president of the Boa; d and attested by the Clerk of said Board, which said license Bhall grant permission to said person or persons to exhibit in accordance with tlio siaiements in said receipt, if said Board of Town Trustees be not in session, then said person or persona, or traveling troupe, shall deposit a receipt as afore*aid, with the Town Marshal of said Town, who shall thereupon issue or cause to be issued a license to said person or persons, or traveling troupe, Bigned by said Marshal and attested by the Clerk of said Board in aceordanoe with the provisions of this section herein before set forth.

Section 4, Be it further orda ned That if any person, or persons, shall give any exhibition, for which a license is required by this ordinance, without first procuring such license aforesaid, the treasurer of said incorporated Town, or ia his absence the cierk thereof, shall institute suit against them, before any justice of Jasper county, in said state, in the name of the “Board of Town Trustees of the Town of Rensselaer, in Jasper County, Indiana;” and the measute of damages shall be three-fold the Amount of money which by this ordinance is charged for such exhibition, and in all such casesisuch Justice of the Peace shall have power to render judgment in any sum as herein provided; and upon such town treasurer or town deik filing an aifldavit before any such justice of the peace that be is apprehensive that the person or pet sons against whom such suit is insulated is about to leave the county, taking with him his personal estate to prevent the payment of such damages, such justice may issue a writ of attachment to any constable of said county co.• mending him to take into his possession enough of said personal property of the person or persons against whom such suit is instituted to insure the payment of said damages, and keep the same in his care till such attachment suit Is determined ; and in ease of such seizure such iustice and such constable shall be govorned iy the regulations concerning proceedings on complaints of replevin. Section 6. Such treasurer and clerk of said Town jball be competent witnesses in any suoh suit; and all damages recovered thereon, and all fees arising from the issuance of any such license as set forth in the proceeding sections of this online uce, shall be paid into the town treasury of said town for the benefit thereof. Baer ion 6. Whereas there is no ordinance governing or regulating the subject matter of this ordinance, it is therefore considered that an emergency exists fbr the immediate taking effect thereof, the same trill, therefore, take effect and be in force from and after ijs adoption and passage.
