An Ordinance To prevent Swine from running at large within the limits of the Corporate Town of Plymouth, in six sections. SECTION FIRST. BE IT ORDAINED by the Corporate town of Plymouth, by the Board of Trustees of said town, that from and after the first day of July, A. D. 1862, no swine shall be permitted to run at large within the corporate limit of said town; and it shall be unlawful for the owner or owners of any swine to permit the same to run at large within said limits SECTION SECOND. And be it further ordained, That, if any person or persons owning or having the care of swine, shall permit the same to run at large within the corporate limits of said town, after said date, he, she or they shall forfeit and pay to the said town the sum of two dollars per day for each and every day they are guilty of a violation of this ordinance, with costs of prosecution, to be prosecuted for and recovered by an action in the name of the town, before any Justice of the Peace having jurisdiction as for a misdemeanor; and it is hereby made the duty of the Marshal to prosecute immediately for any violation of this ordinance coming or brought to his knowledge. SECTION THIRD. And be it further ordained, That it shall be lawful for any person---and is made the especial duty of the Marshal---to take up and put into the public pound, any and all swine found running at large within the corporate limits of said town from and after said first day of July, A D 1862. The person or persons so impounding such swine shall notify the owner or owners, if known, and in all cases shall notify the Marshal. The owner or owners may have each swine released and delivered to them by paying to the Marshal twentyfive cents for the swine impounded, if only one, and ten cents per head for each additional head of swine if more than one, for the first day, and fifty cents per day for each additional day said swine shall remain impounded, fifteen cents of which shall he paid by the Marshal to the person impounding such swine. If such swine are not redeemed within one day after such impounding if the owner in unknown, or within one day after notice to the owner if such owner is known, the same shall be sold by the Marshal within five days thereafter. The Marshal shall advertise such swine for sale, in five public places in the town, giving description of the swine owner's name if known, time of impounding, amount of charges, and time and place of sale; and if not redeemed before, such swine shall be sold at the time and place mentioned, to the highest bidder at auction, and the swine be delivered to the purchaser. SECTION FOURTH. And be it further ordained, That the money arising from such sale shall be used 1st---To pay the fees for impounding and keeping said swine; 2d---The costs of sale hereinafter provided for;. 3d---The penalty and costs provided for in section second of this ordinance, if judgment has been rendered therefor; 4th---The residue, if any, shall be paid to the Treasurer of the town, to be held subject to the order of the owner of such swine. SECTION FIFTH. Be it further ordained, That if swine impounded are sold, the .Marshal shall be entitled to fifty cents for advertising each sale under this ordinance, and ten per centum on the amount of all sales, in addition to the fees for redemption above provided, and if such sale shall be advertised, and the swine be redeemed before sold, the owner shall pay said sums in addition to the sums above herein provided, to the Marshal, before said swine shall be released. SECTION SIXTH Should the Marshal fail or refuse to impound swine when found running at large in said town, (having knowledge or notice thereof,) and proceeds to carry out the provisions of this ordinance as to his duty thereunder, he shall forfeit any pay to said town a sum not less than one nor more than three dollars, with costs of prosecution, for each and every case of refusal or failure, to be prosecuted for in the name of the town, as for a misdemeanor.
