Stocking for murder, from the Tippacanoe Circuit Court, having been filed in the Supreme Court, and one of the Judges of said court having informed Gorerr.or Wright that the.Supreme Court is not in session, and cannot examine these cases until the next November Term, the Governor on yesterday respited the sentences of said persons, fixing the time of their execution for the 11th day of January, 1656. nftttc!. Health or New Orleans. The fever is increasing in New Orleans, and still greater mortality is apprehended. The Xew Jersey Railroad Accident. Burlington, N. J., Aug. 31, The number killed by the railroad accident is now ascertained to be only 30. The two bodies not recognized yesterday proved to be those of Mr. Humphrey of Illinois, and Hugh James of Newark. The wounded are mending rapidly. Norfolk, Aug. 30. The feYer rages as badly as ever. Among the new cases are Lieut. R. L. Page, Lieut. James Henderson, and two of the Philadelphia physicians who recently arrived here. The wife of eommander Whitle is dead. The new cases are of a milder type, for the deaths in the two cities for the last 24 hours were but 35. Alabama Election. The Montgomery Advertiser publishes ihe returns of the election for Governor in ali the counties except two namely, Covington and Washington. It foots them up as follow: For Winston. 40.991; Shotridge, 29,471 total, 70,462. Winston's vote in 1853 was 30.8G2. He had three opponents, who eot in the gSr'gle. 17.623 votes. Total, 49.435. These figures show nn increase of the total vote OTfr thit of 1853 of 21.977. They show an increase of 10 121 for Winston as compared with his vote of 1853. The Result in Kentucky. Baltimore. Aug. 26. -Seventeen deaths from yellow fever are reported ns having occurred at Norfolk and nineteen at Portsmouth. Mayor Wood has recovered Dr. Lovett is dead. New cases are very numerous in both cities. . Baltimore, Aug. 27 Reports from Norfolk represent the fever as still unabated. Arrival of the Hermann. New York, Aug. 29. The Hermann arrived about 10 P. M. Among her passengers is Capt. Allison, U. S. Navy, bearer of dispatches, and Com. Crabbe, Commander in chief of the African squadron, who reports that Col. Hart, American Consul at Santa Croix. Teneriff, died of appoplexy on July23. The sloop of war Jamestown sailed from Teneriff for Port au Prayo July 25. The British parliament was prorogued on July 14th. The Queens speech was dolivered by proxy. It congratulates the country on the increasing strength of the union between France and England, and the accession of Sardina to the alliance. regrets that the Vienna conference proved ineffectual, but those endeavors having failed, no other source is left but to prosecute tho war with all possible vigor re'ies on the patriotism and the galantry of the army and navy to carry it out. Parliament stands prorogued until JDctob.r 23J. Frcra Kansav Chicago, August 29. Kansas dates to Monday evning are received. The bill for electing all Territorial officers by the present Legislature passed. The two Houses were in joint session for the purpose of carrying out the elections. The bill provide that all local officers, including sheriffs, corslables, assessors, &c, for the next six years, be elected by the present Legislatuio. OrncE or Attorney Gesebal Indianapolis, Ind., Aug. 15;h,'55 Since my circular of the 28th of July, I have been repeatedly and urgently asked to express an opinion in regard to the proviso to the 10th section of the 'Schedule of the constitution; which provides that no person then in office, &c,, shall continue in office after the taking effect of the constitution, fo; a longer period than te term of such office prescribed by the constitution; which means that a clerk of a circuit court, or a recorder, elected for seven years under tha late Constitution, shall hold but for four years. A number of these officers ire inclined to test the question of their right to hold for the term for which they were elected; but they generally express a willingness to be guided by my opinion; and they desire it now. because notices of the offices tobe filled at the approaching general election must soon be given, and pollbooks prepared. - Under these circumstances I would be glad to satisfy them; but I regret to be obliged to say, I have no settled opinion on the subject.- I find no authoritative decisions that meet the point; and considering the question an open one, and yet wishing to relieve the officers having pending duties to discharge: from a perplexing responsibility, I would suggest to them the following course of action; Let notices of the election, be given as if the proviso, were unquestioned. The notice cannot, I think, be any evidence
of either a resignation, or a waiver of (he claim to hold the office; and any clerk intending to try the question, might state the intention in the notice. Should the incumbent hold over, the claimant of the office would of course institute proceed, ings to oust him. The question is whether the office is ia the nature of a contract between the State and the incumbpnt. and as such protected hy the clause of the Constitution of the United States, inhibiting the States from passing laws impairing the obligation of contracts. That clans has been much discussed and extensively applied. It has been held to "pply to grants from a State to an individual, to charters and to corporations; and to laws forbidding the interference with the thing granted. But there are important qualifications to the general rule; mid there are powers of government whieh it could not have been intended to take away by this constitutional provision. Was it iutended to apply to laws tli.it miaht be enacted in regard to the discharge of public duties; or tolhe possession or exercise of public rights, or to the enjomiit of public offices; or to the changes in any of these. iht the Legislature of a State, or a ferliori, tho people of a State in their sovereign character, might at any time deem expedient? Allowing due weight to all that may be reasonably urged Against the proviso, as invading invested rights, I incline to the opinion that the courts will sustain it. For answer to Probate Judges, County Commissioners, and some others, I would state, that the late decision of the Supreme Court only applies to cases where the term

In this variable climate of ours, where lung and throat comptaints have become so prevalent and rife, we earnestly recommend to Ihe public, and to the afjlictrd especially, to avail themselves of Dr. Curtis's remedy.
