Artnian, Republican and former speaker of the Indiuna house of representatives, lias rendered his decision in the suit recently filed here by the Democrats to test the constitutionality of the last legislative apportionment act. It appears that by tne act of 190:$ forty-ix of the nine ty-two -ounties were fo:ined into twen ty senatorial districts, ten of those bar ing a voting population of 109,707, or an average of 15.970 voters to each senator, which is 2,090 in excess of the official unit. The other ten of said twenty senatorial districts have a vot ing, population or iiJ3tjy. or an aver age of ll,73(i voters to each senator, -which is 2.150 less then the official unit. The legal opinion is advanced fhat the land owners along .the Wabash river own xthe 2a nd to the middle of the river, and that the mussels are a part and parcel of the laud, and that no one but the owners have a right to take the shells. If this opinion holds good, the inussel-shell gatherers will experience trouble next season. Last summer hun dreds of men along the river were Engaged in digging mussel shells, and they realized a good deal of money.-. Arrangements are making to hunt the niuäselä on a more elaborate scale next ummer, and it has been estimated that employment will be given to from 2.C0O to 2..rA)0 people along, the Wabash and White rivers. Fort Wayne, Ind., Feb. 2. Theodore Kobbins, a millwright employed by the Fort Wayne Iron and Steel mill, was crushed to death.. The accident oc-. curred while he was- oiling the carrier chains. His clothing became entangled in the machinery and he was drawn into the rolling mill. His body was mashed into a pulp before the machinery could be stopped. Suicide of a DrnpgUt. . Spencer, Ind., Feb. 2. F. JL Drake, a druggist, Is dead of poison, the deed being due to domestic troubles. "In live hours I will be dead," he said to a customer, who was in his tore in the morning. About '-fifty employes of the various traction lines that center in Indianapolis have organized a union. The organization U not complete, but the organizers think it -will grow rapidly. High wiuds pre vailed along the eastern slope of the Rocky Mountains in Colorado and Wy oming, and much damage to property was wrought. In Denver two men lost their lives as a direct result of the gale. , Charles Ormsby and William Daniels came in contact with a live electric wire which had been thrown from the fastenings into the street, and wrere instantly killed by the shock. Ilepcrts are being received from points in northern Colorado telling of much destuctiou of farm buildings and other porporty. but the most notable effect of the wind was the wrecking of a pascseuger train on the Colorado and Southern railroad, two coaches and a combination baggage ear and express car being blown over and nearly de molished. The engine and tender re mained on the track. Four of the train crew and one passenger were injured, as follows: J. K. Iiobinson, expess messenger, ribs broken, internally injured, may die; W. Groff. the inventor of the street letter box fastener contracts for the furnish ing cf which are alleged to have been imrvoperly obtained, took the stand iu the postal trials and told how he ccncelved the Idea of petting up the de vice, and. the efforts made by him to find some one beside his brother to take an active Interest in placing it. The fastener had been adopted and an ordtT for the Washington postoffice paid for, he testified, before Lorenz, In 1SD5, proposed to worii up a senti ment .in fvor of it among the pestmasters of the country. The witness declared he never spoke a word to Machen about the fastener other than to admit, in response to a question put by Machen at a public test, that It fitted too tightly. L'p to that time he said he never had heard of Lorenz, and after making the agree ment with him witness said he never saw him again until last summer, nine years afterward. . In the senate Dietrich of Nebraska made a request for an Investigation into charges on which he was tried recently by a federal court in his own state and the senate granted the request. The remainder of the day was devoted to an argument by Morgan In support of "the resolution directing the senate committee on foreign relations to make an Investigation into the Panama revolution. An executive session was held. The proceedings in the house were the Panama question. Thayer (Dem.) of Massachusetts declared the course of this government In Panama to have been contrary to the provisions of the treaty with. New Granada. HcKinley'a b.rthday was generally observed in Columbus, the greater number of persons ou the streets wearing carnations. New ILavrn. Conn., Jan. 30. Men of distinction In the business, political and social life of this state were guests at the banquet of the McKinley asso elation of Connecticut. A letter from Secretary Cortelyou, highly eulogistic of the dead president, was read. Washington, Jan. 30. A carnation adorned the lapel of the coat of nearly every member of the house in commeiuoration of the late President McKinley4 birthday. The chaplain referred feelingly to the late prccident New York, Jan. 30. The annual McKiul2y dinner of the West Side Republican club was held at the WaldorfAstoria. Chicago, Jan. SO. The Hamilton club here celebrated the birthday ot McKinley, by unveiling an oil portjalt of the late president. At Canton, O., day was duly observed; also at Philadelphia, Omaha and numerous other places.

Widows, and Orphans of the Harwick Horror Are Destitute Late t News from tho Pit, PittsbuTg. Jau. 20. The following appeal has been issued by the relief committee at Cheswick, Pa., by telegraph: '"One hundred aud eighty-four miners killed. Families destitute. The committee urges immediate and generous aid. Jeorge A. Iligley, chairman of relief committee." Among those to whom the telegram was addressed are Andrew Carnegie, Resident Roosevelt, Senator Hanna and John I). Rockefeller, and to the mayor of every important city in the country. Rurial processions and rescue parties in charge of newly recovered bodies passed each other en the road that leads from the Harwick mine to the morgue all day. Of the 100 bodies recovered and taken to the school house morgue fifty-six have been identities!.
