Fdloic Citizens: Through the: columns ol'tho Public Leger, I wish to comrouniv.itc to you the passage and the manner of the passage of the act, establishing county -eminane, also the ground I occupied, and the supposed delinquency of which I am charged. In the first place, the Bill originated in the senate, and wna reported to the House of Representatives, on the afternoon of the 24th January, three days previous to the adjournment of the session.

I't was read a first and second time, (the rules having been dispensed with) and made the order of the day for that day. While the Bill was under consideration, Jewi, from Franklin, oCcred the following amendment: Sirike out that part of the first section, which authorizes the Judges of the circuit Court, to appoint Trustees, and insert the the following in lieu thereof: "That the qualified voters, shall, on the first Monday of August nest, and triennially thereafter, olect the Trustees for each county therein named, and in case of death, resignation or o'herwitie, it shall be the duty of the Circuit Court, in term time, or the associate Judges in vacation, to appoint some suitable person, or persons to fill such vacancy untill the next annual election." O.i the question, shall the Bill be so amended, and the ayes and noes being demanded, 35 gentlemen voted in favor of the amendment, and 1 1 against it. Two of my colleagues and myself voted for the amendment. The amendment, was then ordered to be engrossed with the bill,

a .d read a third time the nest day. 1 i;e Bill was accordingly read a third time, a rt! p;ised as amended, and the Cleili or , d "red to inform the Senate thereof. On the evening of that day, the Senate informed the H. R. that they disagreed to our amendment. A motion was theo made by Dr. Ferris, that the 11. R. recede from tholr ammendmerjf, which motion prevailed: two of my colleagues, cud in) sell Volt-d in the negative. This fellow citizens, is a plain statement of Ci ts, ns per the records of the House willnppear. But I am charged witn d -ii'jiifncj, in not Using every possible exertion to defeat the passage of the Bill; c?p dully as It relates to the county of ayue, and that I suffered the amendment m ule in the H. R. afterwards, to he lost end also that 1 did not on that occasion, endeavor to act the part of a Ciav or a roster. In filing my replication to those .-vveral charges I shall be .brief. In the tint place, it is well known even to a novice in the science of Legislation, that for some three r four dajs, immediately preceding the conclusion f a session, time - not given, nor an oppoitunity offered, to make strong impressions on the minds

of the members; as their chief concern is speedily to -wind up the business before them which mostly consists, of message to a d from each other. In the second pl?-T, I had no disposition to "defeat the pasvge of the Bill, after the amendment was adopted, as I conceived it would he settling a question in the county, which antecedent t. that time, had made come noise, and I had no Dresentiiuent of the

eiate?s disagreement, until immediately before th final adjournment of tbe cession. A very large majority 'of the 11. H. having supported the amendment, $ had every condence that Dr. .Ferris' motion rould not he sustained, nor ceo Id I possibly bnuw it until the question was tcben, and after it was Ukcu and carried it became a law, as fr as the two houses were concerned. The only course I then could hnve pur ed, would have been by a reconfiguration of the vote jest taken, -which t-Jd not have curried cn the face wf if the least probability, as that would be instantaneously undoing, crhat the house liad just done, it was a cool and candid decision. I occupied the .flo ra few mituites in support of the amendment; and perhaps as much was ceid in opposition to it. I. did not then know that my constituents uould make it n tizz qua nan, cs to the ultimate disposition of this question in my . reelection, nor can 1 yet -tliink they will. From the commencement to the final dctetmina

They may modify cn amendment frc.ti the ether house by ingrafting an amendment on it, because they have never creentcd to it; bet they cannot amend their oun amendment, because they have, cn the question, passed it in that form." And then cn the third rcadTof bills, he cays, "after the kill t3

passed, there can be no further alterations

of it in any point. iiow to the eubject it has been alleged, that, through popular motives, Iwasdetered frcm opposing the bill, that 1 waa ueder Jhe control or feat of parties. In unsrer, I at once declare that to my recollection, such an idea r-ever entered my mind, nor shall any interest

separate and distinct from a general one, ever influence my vote, while esercisisj

Yet I must contend, that there were other acts passed cf mora im?diate benefit to the people, and in uhich tbey have a deeper interest, 'lore than six hundred dollars le;3 will be paid into the state treasury th:?year than was paid l ist ye.ir. By the amendments mada to the f.lililia Law, a sum, I presume, not far short of the above will he retained in i ur cur.ty, end perhaps annually hereafter. This I conceive to be of greater advantage than $450, (the Seminar) futid at this tiuiC,)or its application in any part it ul.ir section uf our county, especially when it is known that this sumi the product of ten years Before I dismiss the subject 1 will touch on this would bo obnoxious act. Since the subject has made a tangible appearance I havo endeavored to ascertain the mrrits and dements of the act. I discover the Trustees must give bond, and take an

joath for the faithful pwrformai.ee of their duties. I understand the word duties to , mean, the selection of a cite for a County ! Seminary edifice embracing more general j advantages and interests than any other, ,(md I think it might be further suggested)

When acting under oath pen are generally c .ndid, and act v. ithout Corruption; and if corruption or improper conduct can be fized on them, crany of them, on complaint made, the Circuit Court bo power to remove them. In the n Rt place, the justices of the peace are apportioned to the different townihips, in proportion to the number of inhabitants, cic. tt:d as uch may justly be considered our rrpuesntalives in settling questions wherein the county is interested. The act heti provides, that after the Trustees bavs performed their duty, in the selection cf a cite, &c. they sh tll lay their proceedings before the ntst Board cf Justices br their

approval. If approved cfby tbo, cr a majority of them, the contracts .nd proceedings of the Trustees become binding; if disapproved cf, they Consequently become void. Then, besides tha bjnd and oaths of the Trustees, the Justice!1 Court acts as a check upon their prcc6diiigg, wl.ich might be ecr.iiercJ almssta tantamount to a plurality cf Votes. Celying therefore cn the. correctness of thT Trustees, together with the Justices9 Court, I will close the subject, and cr.ly r.i, that
