Isk every epplicalica for the benefit of the act aforesaid, whether made by the 8iarvg officer or soldier himself, cr by his w.-.j.w or minor child or children, a declaration, under oath, must be made as nearly according to the following forms as the nature of the case will admit. Each declaration, and nhhl&vits, must be sworn to before some justice of the peace or other oScer authorized to administer oaths for general purposes, who must certify the same. The ofacial character and signature of the magistrate who may administer the oath must be certified by the clerk of the proper court of record of his county, under the seal of the court. Such certificate must accompany every case. In every instance where the certificate of the certifying officer who authenticates the paper is not written on the same sheet of paper which contains the affidavit or other papers authenticated, the certificate must be attached thereto by a piece cf tape or narrow ribbon, the ends of which must pass under the oSciai seal, to as to prevent any paper from being improperly attached to the certificate. The 3d section, in express terras, only provides for the location of a warrant un der the law. Thus, the right to locate not being given to an assignee, the De partment may well say that no assign meats made prior to location will be re cognised. Tha 4th section declares all sales, &c, going to aSect the title of any land, granted cr to be granted "prior to the issue," shall be null and void, and expressly de clares that the land located shall not be charged with or subject to any debt or claim "incurred " prior to the issuing of the patent." If any officer or soldier who would be en titled to bounty land under said act, if living, has died, leaving no widow who still survives him, but leaving a child or children under the age of majority at the time' of the passage of said act, such minor child or children are entitled to the same quantity of land that the father would be entitled to if living. In such case the guardian of such mi nor child or children must make a daation as nearly corresponding with the foregoing forms as the nature of the case will admit. If no public or private record cf the marriage exist3, or can be procured, that fact should be set forth in the declaration; and in such case, other evidence, such as the testinaony cf persons who knew the parties in the lifetime of the husband, and knew them to live together as husband and wife, and to be so reputed, will be admissible. Cj- In no case, however, will the mere statement of witnesses that the claimant is the widow of the deceased be taken as evidence of the marriage; but the witnesses must state the Jacis and circumstances from which they derive their knowledge or opinion that she is the widow of the deceased. : A certificate from the clergy men or magistrate who solemnized the marriage 13 not competent evidence, unless the genuineness of the certificate be proved, and the person who gave it be shown to have been authorized to solemnize marriage.
