AN ACT To increase and extend the benefit of Common Schools. ArrisovED January 17, 1S49. Src-no" 1. Be it enacted by the Genaral Assembly of the State- of Indiana, That ther f-hall f annually assessed, collecttfd end paid, (its the Statu and county reveiiu is assessed, collected and paid,) for the purpose of increasing the common fchool fund, to be appropriated exclusively for the support of couunon schools: Fir.-t, on

The several taxes hereinbefore mentioned, (with the exception of the tax upon premiums of insurance, shall, together with the surplus revenue fund, the saline and bank tax fund, be and hereby are set apart for the support of K;hools, within the respective counties of the State, and shall be denominated the county common school fund. t v. ii. It shall be the duty of each and every school comm ssioiier, at the term the board doing county business next after the passage of this act, to make final settlement of his accounts with the county and, tor, (which said settlement j shall be entered upon the record of said board,) and pay over to the treasurer of the couuty all moneys remaining in his hands as such commissioner, and to deliver to the county auditor all the books, papers, and securities for money loaned, appertaining to his said office; and the olHee of said commissioner shall thereupon be abolish ed, and thereafter all moneys, whether principal or interest, which by existing laws are required j to be paid to the school commissioner, shall be paid to the county treasurer; and all other duties and services which are required to be performed by the s hoo commissioner by any existing law shall he performed hy the couuty auditor, and the said treasurer shall issue his receipt for all monies so paid to him by the school commissioner, which receipt shall be tiled with the county auditor, who shall charge the said treasurer therewith. Sec 5. For their compensation for the discharge of the said several duties prescribed by the loreguing section, or which may be imposed by this act, the said cou nty auditor shall be al lowed upon the amount of the congressional township and school district funds, and other i

Sr.c. 9. The business of each district shall be transacted bv on district trustee, who shall be r-hcted annually bv th qualified voters of the district, on the first Saturday of September, at which time also the general meetings of the voters of each oistrict shall iierealterbe held, and the said trustee shall continue in office until bis successor is elected and qualified. Src. 10. the board of township trustees; lie phall make all contracts, purchases and sale? necessary to carry out any vote of the district, for the procuring of any site for a school-house, building, hiring, repairing or furnishing the same, or disposing thereof, or for t!ie keeping of any school therein, and all payments shall be made by the treasurer of the township trustees, upon the certificate of district trustee as to the performance of the service or labor, or the rouvej arice of the property contracted for, and whenever from auv
cause the said district trustee shall not be present at any meeting of the voters of the district, the meeting1 shall appoint a chairman, who shall for the time bemrr uischaree the duties ol such trustee. Sec. 11. The district trustee shall act as th? organ of communication between his district and female, between the aires of five and twenty-one years of age, distinguishing between five and ten, and ten and fifteen, and tilteen and twentv-one years of age, the whole nu-i her of scholars, the average attendance, the length of time a school has been taught, whether by a male or female teacher, the branches taught, the books used, whether the district has a school library, and if so, the number and value of the volumes, the condition of the school-house and furniture thereof, ;ujd of what the furniture consists; and the clerk of the board of township trustees shall certify the same to the county auditor on or before the fir.-t day of October annually, together with :i statement of the amount expended in the seve ral districts of their township for tuition and all other expenses. Sec. Id. In cases wheie any school district may be formed out of portions of adjacent townships, the report required of the district trustee shall be made to the clerk of each of the townships in which such district may lie. Sec l.i. It shall be lawful for the qualified voters of any school district in the State, at any general or special meeting thereof, to vote a tax ior the purpose ot building a school-house, or repairing the same, or providing fuel, or such gregate amount ot all taxes, so levied hy a vote ol the district, shall in no case in any one year, exceed the amount of fifteen cents on each one hundred dollars worth of properly. Sec 11. When any tax is voted to be paid in labor, it shall be worked out under the superviion of the district trustee, and w hen any person charged with a tax payable in labor, shall fail to discharge tlwsamealter two weeks' notice to com ply with the proper requisition, the district trustee shill report the same to the clerk of the board of township trustees, whose duty it shall be to bring suit therefor in the name of the board of township trustees for the use of the proper district, and a recovery shall be bad, at the rate, if any established, for commutation, if not at the rate of seventy-live cents per day, and an execution shall le issued thereon, which shall not lie subject to any relief what -ver from valuation or appraisement laws. Sec;. 15. When any tax is voted by any district to be paid in money, the district trustee shall make a list of all the taxable property within the district, together with the names of the owners, and shall tile the same together with the votes of the meeting, directing the same to be levied, with the county auditor. Sec. If). The. auditor shall make the proper assesment thereof, upon th property charg tble, in the same manner as for State and county revenue, a coroii:r to the ta polar ; ppraisement thereof, in bis ollice, and shall add the amount of said taxes to his duplicate in an archarge, so as to increase or diminish their barge, so as to increase or dimini: s;ze, and may consolidate two or more into one, or may add oarts of oim or more to others: and the trustees of adjacent towns ps may lorm a district out of parts of such townships, but no sub-division shall be ma.de to reduce the, number of scholars below twenty-five iu any district. Provided, however, That before any subdivision shall be mace, the township trustees shall give thirty days notice of the propose.! charge or subdivison, by posting the same in three public places, within the o.btriet or districts to be alb'Cted thereby, and thev shall also give personal nct.ee thereof, to the trus tees ol the districts to be idl-'eted. Sec. IS. In order to enable th trustee of the district to make the reports which are required of him by this act, the teacher of each and evorv school district shall, at the expiration of the term of the school for which he shall have Iwn employed, furnish to the district trustee, a full and complete statement of the whole numbered" scholars admitted to the said si hool, the average attendance, the length of time the school has b-eti taught, the branches taught, and the books us-d: and until th d report sh d! have b -en furnish ed bv the tear her as afore: it shall not be lawfill lorthe district trustee to issue the said teacher the certificate entitling him to his compensation us such teacher. Sic I'd. Sec 20. of State, as superintendent of common schools, to condense the reports of said Auditors, and submit the same to the General Assembly during the firs! wek of the session thereof. Sec. 2-2. The township and districftrustees sha'l each be allowed the sum of seventy-five cntper day. for each and every day employed in the discharge of their respective duties, and thev shall
keep an acccount ot the number ot cays, the parts of days so employed, which account shall be verified by the oath or affirmation of the said, trustees, and the compensation of the district trustees shall thereupon be paid by th? treasurer, of the proper township, out of the funds of the proper district, and for the compensation of the township : trustees, the County Auditor shall draw his war- ' rant to be paid outof the funds of the proper townshin, t 5? ec. 23. If any county, township, or district ; officer shall fail or refuse to discharge any of the I duties of his oliice, which are now, or may here- ; after be required of him by law, such officer bo offending, for every such offence, shall be liable in an action of debt to any person suing therefor, in ', the name of the State of Indiana for the use of j the common school fund, in such sum not exceeding ten dollars, as any Justice of the Peace of the proper township trying the same may deem rea- ( sonable. which sum when collected shall be if from ! a district officer for the use of the school fund of1 his district; if from a township officer, for the use of the school fund of the proper township, and if from a county cdfieer, for the use of the county ! common school fund, and any person elected to the office of township or district trustee, who shall neglect or refuse to qualify and serve as such, shall he liable to pay the sum of live dollars, to be re- j covered as herein before specified. j Sec. 21. The Treasurer of State as superinten- f dent of common schools, shall be allowed annually the sum of for the performance of the several .services required of him. Sec. 25. In all cases where there shall be any i fractional congressional township or townships in , any county containing a less quantity of land j than six square miles, tne said township or town- j ships shall be by the Auditor of the proper coun- ; ty, attached to, and made to form a part of the adjacent township or townships for the purpose of having the same distributed, and for school purposes, and it is hereby made the duty of the several Auditors, so to attacli the said townships, and of the township trustees of the township to which the same may be attached to take jurisdiction thereof and district the same, and to go and perform al: such other acts, n. alters and things which I may be necessary, as though the same were originally a part of their proper school territory. j Sec. 2G. The several school commissioners, and all persons who have heretofore held the said ' office, as their securities, are hereby declared lid- i hie for any and all moneys, and other property, j belonging to the school lund, remaining in the ; hands of the said commissioners, or persons who ; have held the said oliice, unaccounted for, and it is hereby made the duty of the county auditor to commence and prosecute to fund judgment, ' suit or suits, in the name of the. State of Indiana, for the use of the common school fund, against l all such commissioners and persons who have : : held the office of school commissioner, and their j i securities, for any and all such moneys or other i : property remaining in their or any cf their hands j : unaccounted for, and inajl eases where any such , school commissioner, or person who has held the i I cilice of school coinmissoner or any of their se- ! I curities, shall have absconded or otherwise left j ! the State of Indiana, having any money or other ; ; property belonging to the school fund unaceount- j ed for, or being surety for any defaulting schcol- I j commissioner, it shall and may be lawful, and it shall be the duty of the county auditor to com- j mence and prosecute to final judgment, in the : name of the State of Indiana for the use of the ' ! common school fund, writ or writs of foreign or ; domestic attachment against thu goods or eliatj tt Is, lands and tenements of such absconding or removed commissioner or security, which said ; writ or writs may be levied upon any properly, ; subject by the laws of the State t execution, and the proceedings in such case shall be governed in all respects by the statutes regulating proceedings in foreign and domestic attachment, with this exception, that the bond or bonds re- I quired ol individuals by the said statutes, shall be ' j in such cases dispensed with. 1 Sec 27. In prosecuting any of the suits re- ; quired by the foregoing section, the county au- j i ditor shall be and he hereby is authorized to employ counsel to conduct the said suits, i t such reasonable rate of compensation as m.iv be agreed upon. Sec. 2S. Any State, county or township officer, having the. charge of any of said school funds, ; who shall embezzle, or apropriate to his own use, any of the school funds, shall, upon conviction, or presentment, or indictment, be fined iu any ' sum not exceeding four, nor less than two fold ' the amount so embezzled or npprepriated to his ; own use, ami be imprisoned in the county jail for not more than six months, al the discretion of the court or jury trying the same. Sec 21'. Whenever school houses l ave been erected by private liberality, and schools established tliTein.it shall and may be lawful for the trustees of the township in which the same may be situated, to recognize the same as a public : school, and to make such allowance thereto as ' may in their judgment he just and equitable. Sec d0. All acts or parts of acts conflicting with any of the foregoing provisions, be and the s.xine are hereby repealed. Sec 111.
