Temporarily at least it is the judgment of the an* preme court that the inoome tax law waa not constructed wholly on constitutional lines. I It may even he true that a majority jof the present bench believes an inoome ta:c unconstitutional under opr form of \ federal government The history of political progress is largely made up of revisions of opinions authoritatively pronoun oed. Professor Hurley has declared that the chief duty of science in each generation is to discard the errors of the science of -a preceding generation. If decisions by the supreme court of the United States since this government was founded had remained on the books in the farm in which they were originally written, it is doubtful whether the American Union would be today a political fact, or 4f it were mqre than one of the noblest monuments in its progress oould not have been erected. It js reasonpbly.certain that while the justices deny -that politios bad anything to do with their individual positions .concerning the inoome tax law, ill repressed irritation displayed during argument by counsel fully justifies a popular belief, which will extensively prevail, that the protection superstition affected a portion of the court, perhaps junoonsciously, but effectually. There are rumors that some Democratic members of the court donbt the .constitutional soundness of the statute, but there is nothing in the decision to support this rumor. The question which the court, so far as the decision shows, considered paramount tpas one of detail, not of principle.
Ill was, in substance, whetner or not in certain features of the law oongress had not usurped to itself fiscal privileges reserved by the constitution to individual states. Under the oloud thus raised the court holds .that oongress is inoompetent to tax incomes derived from .real estate and state and municipal bonis. JPhis portion of tjbe decision will necessarily render the ivy odious to a vast majority of the people* as the last oensns shows that a third at the farmers pay rent, and that the same is true xst three-fourths of the people living in cities of over 100,000 population. The payers of rent, if their incomes reach the taxable limit, will cqme under the 8 per cent, mulct, while the receivers of rent, which goes to make so vast an element in the wealth of the country, will ^go soot free under that head, coming under the law if at all only as recipients of taxable in come from other sources. It is estimated that the loss to be thus inflioted upon the revenue anticipated from the law by the treasury will reach one-third the total amount Oia one point the court appears to have been unanimous—namely, that it is ‘within the powers of congress to fix the limit at which an incpme tax shall be,gin. This point conqeded, it would appear to be conclusive as to the actual judgment of at least a majority of the court concerning the constitutionality of the principle of an income tax, rumor to the oontrary notwithstanding, for unless a minor premise swallow up .a major congress cannot have the power to say where an income tax shall begin ^unless it have the power in principle under the constitution to lay the tax. Happily Secretary Carlisle is able to give assurance that no embarrassment will come to the oountry from the present efteot of the decision, whioh is fragmentary, compromising and self conflicting. Increase frpm customs receipts, be confidently predicts, will more than
onset disallowance on toe classes oi property excluded by Jthe decision from opera tion of the law. 'Unhappily the effect of the decision wil) not be as easily counteracted in the pnblio mind. The legal subtleties with which parte of the decision are vitalized will be bat slightly appreciated by the great mass of the people whose industry brings them under ^3e law, while it exempts those more fortunate than themselves, whose surplus remains intact " One of the consequent of the decision most to be deplored Is that it will revive thedbeping imposture, protection. In thropeoious guise of supplying revenue not available under the income tax law, as amended by the oourt, there will be renewed clamor by capital for restoration of tariff monopolies. Should the next congress, instead of recasting the law so as to preserve its principles, a principle approved by the experience of all organized governments and suopessfully tested under every constitutional structure, supplement it with increased protection duties, suob legislation would only double the burden laid by the decision upon labor. It wonld Still have to pay its share of the inoome tax, if unrepealed, and' in addition to that fresh tribute tp monopolies under tlje subterfuge of furnishing needed revenue to the national treasury, Rather than submit to twofold oppression, the country would undoubtedly prefer Repeal of the inoome tax law altogether and snob readjustment pf customs and Internal revenue taxes gs shall furnish necessary ipeans far the federal I' at the lowest imposition upon the productive industry pf the nation. A ohitnge in the personnel of the supreme court may yet afford a remedy against nullification of the prinoiple of the inoome tax, scientifically and equitably framed in a statute. This consummation is devoutly to be wished as probably the only guarantee against yevival of MoKinleyism and ite horde pf evils. —Chicago Times-Herald.

He should be made to realise that, characterless as the United States senate is. his presence there Is an affront to deoency. He typifies the wont abases of American politics, and the gulf that yawns between Sumner and Chandler startlingly exemplifies the decline of the party of gnat moral ideas. His steal of Florida’s vote from Tilden in 1876 was the most faraaen and shameless of the frauds through which Hayes was seated in a usurper’s chair. His administration of the navy department during an era of good stealing made even Robeson respectable by | comparison. 1 ! His contest with Gallinger for the | control of New Hampshire has been marked by every crime that can be per- ■ petrated against an honest ballot, including a false roll of membership ooni oocted by a clerk and a legislature organized by constables. . His relations with the railroad interests of his state aooount for many things that a $5,000 salary fails to explain. In the senate he is a scolding Thersites whose venom, within the safe precincts of “senatorial courtesy. ” is poured out upon Democrats not to accomplish any public purpose, but simply to gratify malignantB at homo He is-one of the chronic naisanoes of American politics and should be abated. —St. Louis Post-Dispatch. Condition* Which Prevented Making It n -National Lom." The blackguard newspapers that have been attacking the president for earing the national credit now tell ns that the public ought to have been allowed to take the bonds and reap the profit on them. As Home people were puzzled by the chatter about a national loan before the bond sale was made, so some may be deluded by this ohatter based upon the after discovery of a profit in the loan that actually was made. Of coarse no allusion is made to the loss sustained on the $100,000,000 of bonds sold by the government in 1894. The fact of this loss, however, is really the most important thing to be considered in connection with the “national loan," because it was the only thing upon which “the people” could base an opinion as to the advisability of subscribing. The assumptions of the advocates of a national loan are these: (I) That “the people" had $63,000,000 in gold coin or bullion laid away where they could put their hands on it; (3) that the people holding these hidden treasures could and would make up their minds instantly to take the bonds at a price to be named by the secretary of the treasury, there being no means of negotiating with 66,000,000 separate boarders of gold; (8) that the whole business could have been done between Monday morning and the following Saturday night; (4) that the means oould have been devised to prevent tiie immediate drawing out of this gold from the treasury as the previous gold had been drawn, it is unnecessary to say that not one of these conditions oould have been fulfilled, and therefore that this “national loan" leaves Kalstaff's men in buckram very far in the rear as an object of hilarity.—flew York Post._ ▲ Fitting Appointment, Senator Ransom's appointment as minister to Mexico is altogether fitting. a conspicuous and honored member of ithe United States senate far 23 years and would doubtless have been retained there by his state daring the rest of his life bat for the disorganizing upheaval of last fall that put the North Carolina legislature in the control of an agrarian fusion. He is now well advanced in years, but still in vigorous manhood, and he will represent the interests of the United States in Mexico with conspicuous ability It is an honorable retirement for a man whohaa given the best half of his life to the public serv- | ice, and the compliment paid him by | his fellow senators in the immediate confirmation of his domination was mare than merely perfunctory. —Philadelphia Times.
