The supreme court Iasi week declared that the Ihinielh day of May, commonly known as Memorial Day, is not a legal holiday in the sense that prohibits the i-ale of intoxicating liquors on that day. The opinion was written : by Judge MqCahc. The ease was presented on appeal from Jay 'count v in the indictment ot william Atkinson, who was charged with selling liquor on Memorial Day The indictment was squashed by the trial court on the ground thai the law making MaV 30 a legal holiday con templated that the designation was merely for commercial am, = banking •purposes. The law -aid to have beet violated is Section 20s9 R S., 1881 The defense held that the law designa •ing May 30 as a legal holiday is unconstitutional because it was an attempt to amend a statute which had j been merged Into a former amendment. The court denied the pertinenev of this defense and refused to , discuss or decide the constitutionality ,of it, hut held the claim good that the law dots not constitute the day one J during which the sale of liquor is prohibited. The judgment quashing the indictment was affirmed. Labor Day and Washington’sBirthday were included in the amendment mentioned, and it is held that the decision applies to ail three of these days.
