I Much*interest has been taken in the Irvine divorce case in Petersburg from’ the fact that the plaintiff was the murderer of Ed Montgomery at Lincoln, Nebraska, and who was a former resident ot this city. As stated in The Demock at last week Mrs. Ir*dr.e Was granted a decree, but at that time-the amount could not be learn* ed. The court gave her $30,000 alimony and ordered that the plaintiff pay all court costs, witness and attorneys fees which will run the total up to $35,000. The feeling now in Lincoln seems to be that Irvine should have been convicted of killing Montgomery. The following special from bait Lake City, Utah, to a Lincoln paper throws a different phase upou the case altogether: “The Irvine trial is over at last. Judge Powers resumed the closing argument this morning and concluded at 4 o clock. He began by calling attention to the*fact ^ITiat Mr. Curtis of Omaha, in his ' opening statement ot the case to the /:ourf, said that the Montgomery block in Lincoln was a public place and that Mrs. Iryiue often went to au artist’s studio there, but when the defendant was put upon the stand She swore that she was never in the building in her life/ When Montgomery approached Mrs. Irvine as she sat upou the veranda at Garfield B6ach. crying, he said to himself, ^there’s my game,” and the intimacy began that was the beginning of the path which ended when the soul of this seducer aud libertine was sent into eternity by the man whose home he had ruined.

Letters jvere read from Mrs. Irvine to her husband which were most affectionate in tone and showed that their married life was as happy as the average, or more so. After she began to lave Montgomery Irvine had the casket, but Montgomery had the jewel. The meeting at Chicago could not3 bo explained in any other way than that guilt was intended, but her guilty conscience drove her away after one uight had been spent there. The intelligence which Irvine received in Chicago was enough to drive reason from its throne and'realizing that his family was disgraced, and her name dragged in the dust he went to Lincoln and killed the destroyer of his home. Irvine did not want a confession from his wife, for il: could not have been used agaiust her, but he wanted a statement that Montgomery had taken the initiative instead of Mrs. Irvine. While Irvine was tilled with distress and uuable to tear the image of his wife out of his heart in the jail St Lincoln, Smith ’-here trying to

Judge Powers then reviewd tb other features'of the case and sub initted it. After a ten minute recess was take Judge Z&ne rendered his decision He said, in passiug upon the cas& that he. intended doing but litt i more than to state his conelusiou.-: His honor then reviewed the materia portions of the testimony at gre. Coming down to the viow between them, I great love for his wifj to visions and ghosts ed together and finall tal relations. She h him pray before, au derful effect on her. ed something from heir. He certainly misled her an The interviews show guilty of the greatestf treachery, and deceived that he her. was no honest, truthful nmn would do as he did there. In his honor’s mind there was no doubt that Mrs. rvim bout whet liad had told the truth occurred at these Interviews. Irvine insisted on a confession to ‘ keep him from seeing visions. She told aim it would not be true, but he waj ted it anyway and would return it. It was a weak act on her part, but later she said to Mr. Austin that she could not not tell him a lie and that she v is guilty. He then told her not to say it if the^oom was filled with gold. His houor^as uot prepared o sa\, in view ot the manner in wh ch the confession was obtained, that, i; proved her guilt. There was no direct eviden ce that Mrs. Irvine had ever tery except the testi Simmons, the brick) honor believed was committed adulnaony given by ayer, whom his suborn id witness faiid not entitled to belief, and horned li m was that the man who su no more entitled to belief thi n Simmons was. In conclusion his honor found the issue against the plaintifl 'md that the allegation of cruelty was well founded, hence he granted Mrs. Irvine a decree of divorce on the grounds of cruelty {and gave her the custody ot Flossie. Mr. Irvine was ordered to pay all costs of the action including Mrs. Irvine’s witnesses.
