On last Friday J. A. Kiefer arrested Henry Baekcs, Johnny itleisenhelter and George Moore, hoys between the ages of fourteen and eighteen years, charged with stealing rings, knives, &e., from the- store of Chas. WICKED %YATT. John Tamer Wyatt, Accused of Betting Tire to the Pastoffice at This Placet Under Arrest. Shortly after the organization of the Citizens’ GOmmittee, appointed at a mass meeting of citizens held in the coilrt house on Christinas night, for tile detection and prosecution of criminals, strong evidence came, into their possession pointing to John Turner Wyatt as being the party who set fire to tlie postottice on the night of December 8,1882. causing the destruction of an entire block of buildings. Acting upon the knowledge possessed by theta the committee, finding that he was at Lake Providence, Louisiana, caused bis arrest and detention there. W. L. Ilaatrove, ex-sheriff of Gibson county, who is acting in connection with the committee, went after hint about two weeks ago, but owing to some* informality in .the papers the authorities Laving hint in charge refused to give hiui up, and Mr. 11. was obliged to return without him. However, the papers were corrected and Mr. U. left again Ijist Friday and is now daily expected to return with the prisoner. The evidence against Wyatt Is said to be his own admissions to three*different parties and quite sufficient to convict him beyond a doubt. On account of the insecurity of onr jail he will probably be taken at once to Princeton for safe keeping. The committee is. doing a good work and should have., the hearty support, morally and financially, of every good eitizen, to the end that crime may be suppressed and peace and security again reign iu our midst. J A final decision was reached Friday riloruipg in the Superior Court in the case involving the claims against the old Straight Line—the Indianapolis? & Evansville Railroad Company. _ The substance of Judge Dyer’s decision and finding was as follows* He said lie saw no evidence of bad faith on the part of the parties who had acquired the railroad. It trhs just td them to say that. V ... As to the claims of mechanics' for building bridges his opinion was that ; the mortgage under which the trustees held the property was superior to I the mechanics’ claims. He held that I each citizeu of Indiaua to whom the ! railroad was indebted, had a lien to the amount of $100 on the personal > proi»erty of the company superior to ! the mortgage. This law had betgjin ; force' twenty-two years, and0 had never been held unconstitutional. Laws were never deckled to he unconstitutional unless their iniQitidity was clear and apparent. lie held that the right to enforce the $100 lien did not exist for each claim that was held by assignment, but each creditor, no matter how many claims he held by assignment, was entitled to ojdy $100 by virtue of the lien law. f lie held that this lien in this ease covered the raiils together with the other .personal property, and they should be sold to discharge this lien. He held that the evidence which went to prove that the syndicate had agreed for a consideration, which was proven to some extent by parol, to issue debenture® was admissible and should have its, proper weight. Bat it was competent for third,, parties to prove by parol the consideration of a contract to which they were not parties. lie held that the weight of the evidence, was that the floating debt creditors were entitled to debentures. He would in the final decree therefore order that each citizen proving his claim shall receive $100 thereon ont of the proceeds of the personal property and the balance in debentures. He would after further consideration fix in the final deeree who should issue the debentures and the time during which they should be- a valid claim against the railroad company, or the purchasers thereof.
