Weaver, the plaintiff in the above entitled cause, by Horace Corbin his attorney, filed in the office of the Clerk of the Marshall court of Common Pleas, a petition for partition of the following described land, to wit: the east half of the north east quarter of section thirteen, township 33 north, of range one east. And at the April term 1854 of said court, by return of process "not found,' it was made to appear to said court that the above namd Hiram S. Root is not a resident of the State of Indiana. He is therefore hereby notified of the filing and pendency of said petition, and that unless he appear, plead nnswer or demur thereto on or before the calling of the caue on the first day of the next term of said court to be holden et the court house in the town of Plymouth in said county, on the 3d Monday in July next, the same will be taken as confessed and will be heard and determined in his absence.
