By the Board of Trustees of the Town of Plymouth, passed at an adjourned session on the 14th February 1853. Be it ordained by the President and Board of Trustees of the town of Plymouth, Marshall County Indiana, that it shall not be lawful for any person or persons, to manufacture or rectify any spirituous liquors to be used, sold, bartered, or given away as a beverage, within the corporate limits of said town; or to erect any building or buildings for the manufacturing or rectifying liquors therein, within the corporate limits aforesaid, and every person or persons so offending against this ordinance, shall be fined not less than fifty dollars and not more than one hundred dollars, and they shall also be liable to pay a fine of twenty-five dollars for every twentyfour hours that every such establishment is continued in operation, which fines shall be recoverable by presentment, or on complaint before any Justice of the Peace having competent jurisdiction, and the Marshal of said town is hereby ordered to see that the provisions of this ordinance is carried into effect. BE it further ordained by the President and Board of Trustees of the town of Plymouth in Marshall county Indiana, that it shall not be lawful for any person or persons within the corporate limits of said town, to sell, barter or give to any persons any spiritous or malt liq-

uors, wine or cider, to be used by said person as a beverage, neither shall it be lawful for any Druggist, Apothecary or Physician within the corporate limits of said town, to sell or give

the corporate limits of said town, to sell or give any spirituous or malt liquors, wine or cider, to any person or persons until the said Druggists, Apothecaries or Physicians shall file with the Clerk a bond in the penal sum of one hun- dred dollars, with security to be approved by the President of this board, conditioned, that they will in no case suffer any of the aforesaid drinks to go into the community to be used for any other purpose than for mechanical, medicnal or sacramental purposes, and any person or persons offending against any of the provisions of this ordinance, shall, for the first offense, pay as a fine not less than twenty dollars, nor over fifty dollars, and for the second offense be recovered on complaint and proof before any Justice of the Peace having competent jurisdiction, and defendants stand committed until said fines are paid or replevied. AND be it further ordained by the President and Board of Trustees of the town of Plymits of said town, in a state of intoxication shall be deemed guilty of a misdemeanor, & on presentment of any person and conviction before any Justice of the Peace having jurisdiction shall be fined for the first offense two dollars, and for the second offense and every offense fendant stand committed till said fines are paid or replevied. Provided any person who shall be committed for violating this ordinance may be discharged from custody on payment of costs and testifying as to who sold or gave him the liquor by which he became intoxicated, provided, said liquor was obtained within the corporate limits aforesaid.
