Neither can they be distributed in, or transported into the state. Until recently, the sale of cigarettes marked for foreign distribution, which traditionally do not comply with U.S. requirements regarding health warnings or trademark and copyright laws, have been legally sold in the United States, once they have been returned from overseas marketing efforts and have had all relevant taxes paid on them. This will no longer be allowed in Indiana under a new law passed by the Indiana General Assembly earlier this year. As of October 1 under Indiana law, cigarettes in violation of the new law, as well as any vending machines or receptacles in which the cigarettes are being sold, can be confiscated —even if the cigarettes are being given away and even if they have an Indiana cigarette tax stamp affixed. The registration certificate of offenders can also be revoked or suspended. Also, the selling, distributing or transporting of such “gray market” cigarettes will become a Class A misdemeanor —unless over 12,000 cigarettes are involved, or if violator has previous convictions. Then it becomes a Class D felony. The public may file complaints or call in tips of possible offenses to the Criminal Investigations Division of the Indiana Department of Revenue at 317-232-3365 if they notice these cigarettes being sold or distributed in Indiana, or being transported on or after October 1,2000.
