Local officers make arrests
An Etna Green man was arrested for possession of marijuana on March 2 by Nappanee Police. Shawn D. Smothers, 24, Etna Green, was driving a gray and silver Dodge Caravan with a headlight out. Patrolman Tony Schmucker stopped the vehicle and found during a drivers license inquiry that Smothers was driving while his license was suspended. After a citation was given to Mr. Smothers, he was allowed to walk to a phone booth nearby to call for a ride, since the vehicle would be impounded. During a standard inventory of the vehicle’s contents, three partially-burned, hand-rolled cigarettes were found which had an odor associated with burned marijuana. Mr. Smothers was still in sight when this was found, and was arrested for possession of marijuana without incident. He had a prior possession of marijuana arrest, making this a class “D” felony. PUBLIC INTOXICATION Nappanee Police arrested Leonard S. Bindel, 40, Hiawatha, Kansas, March 10, on a charge of public intoxication.

Patrolman Tony Schmucker was on patrol for the local department when he noticed a male subject walking southbound in the area of the 100 block of S. Main St. The subject, later identified as Bindel, was stumbling and nearly fell before Officer Schmucker could stop to speak with him. Officer Schmucker offered Mr. Bindel a ride to the house where he was staying. After Mr. Bindel gave directions to several areas around the southern part of town for approximately 10-15 minutes, Officer Schmucker stopped the vehicle and arrested Mr. Bindel for public intoxication. He was later transported to the Elkhart County Security Center, where he began to become belligerent. ARREST HUFFMAN A Nappanee man was arrested on a charge of operating while intoxicated by Nappanee Police Officer Tony Schmucker. Harold F. Huffman, 61, Nappanee, was driving a pick-up truck eastbound on Market St. when Officer Schmucker noticed the truck had a brake light out. Officer Schmucker followed the

He was transported to the Nappanee Police Department when he began complaining of heart problems. An ambulance was contacted and transported Huffman to Goshen General Hospital. During his treatment, a blood test was given which showed a blood alcohol level of .23936, over twice the legal limit in Indiana. Mr. Huffman was treated and released to reserve officer Sherm Yoder, who transported him to the Elkhart County Security Center on a charge of operating while intoxicated. Mr. Huffman had a prior conviction within five years, making this charge a class “D” felony. DOMESTIC BATTERY Nappanee police arrested Steven R. Hon, 42, Lot 22 Meadows, Nappanee for domestic battery, in the early morning of March 12. Officers were dispatched to the address following reports of a domestic fight taking place. Upon

arrival, Officer Nik Havert was met at the door by the caller, Samantha Bailey. Officer Havert immediately noticed that she had blood on her shirt and face. Ms. Bailey stated that her boyfriend, Steve Hon, had just head-butted her after an argument between them. She claimed that he was drunk and had also threatened to beat her up after she called the police. Mr. Hon stated that Ms. Bailey had beat him up, but Officer Havert and Officer Schmucker found no visible signs of harm on Mr. Hon. Ms. Bailey’s brother backed up Ms. Bailey’s claims and Mr. Hon then put his hands behind his back for officers to handcuff him. After handcuffing Mr. Hon, he attempted to fight Ms. Bailey’s brothers, but he was held back by the two officers. He was transported to the Nappanee Police Department, having been placed under arrest for domestic battery. He was later transported to the Elkhart County Detention Facility. TRAFFIC VIOLATOR Police arrested a habitual traffic violator on March 19. Earl Hampton, Jr., 29, Michigan City, IN, was stopped by Patrolman Joshua Hamer on U.S. 6 at C.R. 9 for having improper registration. Hamer ran a driver’s license inquiry on Mr. Hampton finding him to be a habitual traffic violator, a class D felony. Mr. Hampton was taken into custody and later transported to the Elkhart County Security Center where he will be held on $5,000 bond, pending a probable cause hearing in the Elkhart County Superior Court.
