Arrest two on OWI charges
The Nappanee Police Department arrested two suspects last week on charges of operating a vehicle while intoxicated. The first apprehension was made September 19, when officers were flagged down by a passerby shortly after 10p.m.. The witness gave police a description of a vehicle that was all over the road. Officers immediately got behind the vehicle and attempted to stop it. The suspect failed to signal a turn at the entrance of Meadows MHP. At that time officers attempted to pull over the offender but the driver did not oblige them until he reached his residence. At that time Ptl. Matt Tice interviewed the driver, Israel I. Guevara, age 31, Lot 186 Meadows MHP. Tice reports that it was apparent that the suspect had been drinking. He issued several field sobriety tests to Guevara who failed all of them. The result of the breathalyzer test showed that Israel Guevara had a blood alcohol content of .17%. A background check showed that the suspect also had a prior conviction for the same offense and was driving on a suspended license. After the initial paperwork, Israel Guevara was transported to the Elkhart County Security Center and held on a $2,000 bond. He was scheduled to appear in Nappanee City Court tonight (Wed), 5p.m.. The following NPD officers were involved in the second OWI offense: Ptl. Nik Havert, Ptl. Terry Chanley, Reserve Ptl. Troy Sterling and Reserve Ptl. Chris Sterling. In the early morning of September 20 NPD officers witnessed a beige Oldsmobile strike the temporary flashing four way stop sign at Main Street and the railroad tracks at South Main Streets. Officer Nik Havert followed the vehicle until it stopped in front of the railroad tracks at South Main Street. Upon speaking with the driver, Larry D. Yoder, 46, 651 Miami Drive, Officer Havert noticed that the suspect’s breath smelled of an odor commonly associated with alcoholic beverages. Havert also reports that the driver’s eyes were very red. Yoder admitted that he had been drinking and was given four field sobriety tests, of which he failed all four. He was also given a portable breathalyzer test and failed. Larry D. Yoder was transported to the NPD for a chemical breath test by Officer Terry Chanley. Again the suspect failed, registering a .23% BAC. He was arrested for operating a vehicle while intoxicated, a class D felony because he had a previous conviction for the same offense within the past five years. Yoder was taken to the Elkhart County Detention Facility and held on a $3,000 bond. WARRANT ARREST On September 20, Capt. Mike Anglin observed Phillip D. Harless, 37, Lot #7B Meadows MHP, enter his residence. , Officer Anglin was aware of an active warrant for the subject and called Ptl. Joseph A. Kimpel and Chief Ray Carich to assist him in the apprehension. Harless was located and taken into custody
without incident. The warrant was for failure to pay fines and costs on a domestic battery charge with occurred in 1994. Mr. Harless was processed and taken to the Elkhart County Jail. He was held on a $2,000 bond and his court date was set for tonight (Wed) in Nappanee City Court.
