Coping with estate taxes
By Jay Heckaman New York Life Business owners have wonderful dreams. It’s these dreams that provide them with the strength to succeed. It’s also quite possible that they envision the business remaining in the care and protection of their family after they are gone. Unfortunately, federal estate taxes can shatter this dream and, in the process, leave your family in financial disarray. Federal estate taxes can be so devastating that your family may have no other option but to sell the business to pay for the cost of distributing your wealth. Fortunately, there are ways to minimize the impact of estate taxes and secure the continuation of the business for ycur loved ones. Because of the unique burden federal estate taxes place on business owners and their families, the IRS created Section 6166 of the Internal Revenue Code (IRC). If your business qualifies. Section 6166 allows the portion of the estate tax that is attributable to your business to be paid in 14 annual installments, as opposed to one lump sum. During the First for years of the installment period, th*e executor of your estate has the option to pay interest only on the outstanding tax due. Thereafter, ten annual installments of both interest and principal are due each year. Initially, a deferred payment schedule may seem like a solution to your estate planning needs when passing the business to your heirs. In the long run, however, Section 6166 has several potential drawbacks: 1) Your estate will remain open and unresolved for the duration of the installment period. In fact, the IRS actually places a tax lien on your business to ensure that all of the installment payments are met. 2) Your heirs may ultimately be forced to sell the business to meet the estate tax. If this occurs, any outstanding estate tax will be payable in full. The sale, Early Bird Chirp... Twelve members were present at the December 23 meeting of the Nappanee II Early Bird Kiwanis. Shirley Pitney won the 50/50 raffle, and members were joined by an interclub from Milford, and guests Esther Farmwald, Marie Cleary, Doris Peach, Dick Pletcher, and Bob and Tammy Mullins. Susan Nunemaker was the program chairman, and presented Sara Jane Mullins, who portrayed Annie in the Amish Acres holiday production at the Round Barn Theatre. At the December 30 meeting, eight members were present for the program on Home Health Care in the Nappanee area. Speakers were Dr. Borger, Bonnie Andrews and Shelia Pletcher. Dr. Mike Andrews was also a guest. Early Bird Kiwanis meets each Wednesday at 6:30a.m., at Ron’s Bakery and Restaurant. Visitors are welcome. For more information, call Ron Meister, 773-2179.

Purchasing an adequate amount of life insurance may help to reduce much or all of the estate tax burden that would otherwise fall on your family. Life insurance may relieve the risk that if your business fails to qualify for the Section 6166 election, you have the cash needed to meet the estate tax obligation.
