The City Council of the Citdof Nappanee ordains as Section 1. Application of Provisions of this Ordinance. The Electocal Inspector shall be appointed by the Mayor, subject to approval of the Board of Review. In the event the Mayor or any member of the examining Board determines that the Electrical Inspector is unable to perform or Is not performing toe prescribed duties, a meeting of the Board of Review shall be caled by the Mayor, or a majority of the members of toe Board of Review, for the purpose of selecting a temporary Chairman of toe Examining Board and a temporary Electrical Inspector to be appointed by the Mayor, subject to the approval of too Board of The compensation to to paid to the Electrical inspector shall to el permit tees collected and one-half (1/2) of all license fees collected, paid monthly. Before entering upon the discharge of the duties of the Electrical Inspector the Appointed Inspector, shall file a bond In the sum of One Thousand Dollars ($1,000.00) payable to toe City of Nappanee, said bond to be approved by the City of Nappanee, said bond to be approved by the City Council and conditioned upon toe faithful performance of toe Electrical Inspector's Duties. The Electrical Inspector shall also take and subscribe an oath which together with toe certificate of the appointment, shall be filed wito the City Clerk. The Electrical Inspector shal to removed for cause, only after a full hearing before the Mayor and toe Board of Review, at which time, he shall be entitled to appear and produce evidence why the removal should not take place. SECTION 3. Duties of the Electrical Inspector. It shall be the duly of the Electrical Inspector to enforce the provisions of this ordinance. The Electrical Inspector shall, upon application, grand permits tor toe Installation or alteration of electocal equipment, and shall make inspections of electrical installation, aH as provided in this ordinance. The Electrical Inspector shall keep complete records of ttil permits issued, inspections and re-inspections made, and for other official work performed in accordance with the provisions of

this Ordnance. The Electocal Inspector may hold membership in recognized associations consetent with his duties and n eteercaj iraoec ano wnn the consent of toe Mayor, service on any efectneal committee of these eesodetiens to which el necessary expenses in connection with such activities will be allowed. The Electrical Inspector s empowered to employ, after receiving the approval of the Mayor, any assistants necessary tor toe proper conduct of hie office and the inspection of electrical installations as provided tor in this Ordinance. The salary of such assistants shall be determined by the Mayor or City Council. It shall be unlawful for the Electrical Inspector to engage in the business ol the saw, Retaliation, or maintenance of electrical equipment within the City Limits of Nappanee, excerpt tor toe consulting or other required expertise or information regarding the electrical Installations, alterations, or repair of equipment or buildings belonging to, or leased by toe City of Nappanee. SECTION 4. Authority of Electrical Inspector. The Electncai Inspector shall have the authority to make electrical inspections. When any electocal equipment is found by toe Electrical Inspector to be dangerous to persons or to properly because it is defectively installed, the person, firm or corporation responsible tor the electrical equipment shall be notified in writing, and shall make any changes or repairs required, in judgement of toe Electrical Inspector, to place such equipment in safe condition, and if such work is not completed within fifteen (15) working days or any longer period that may be specified by the Electrical Inspector in said notice, the Electrical Inspector shall have toe authority to disconnect or order discontinuance of electric service to said electrical equipment. In case of emergency, where necessary for safety to persons or property, or where electrical equipment may interfere with the work of the fire department, the Electrical Inspector shall have the authority to immediately disconnect or cause toe disconnection of any electrical equipment Those construction projects that the Electrical Inspector determine are repair rather than alteration, and those project or alterations which do not change the overall electrical service, the Electrical Inspector shall consider under local authority. Those projects under the jurisdiction of the State of Indiana Fire Prevention and Building Safety Commission (I.F.P.S 8.5. C.), IC-12-6 & fc-22-11-1-10), shall be released tor construction by toft t.FK & B S C. prior to the issuance of e permit by the Electrical Inspector. Any of toe duties or powers of toe Electrical

Inspector's may be delegated to any assistants ot the Inspector, by the Electocal 5. Electrical Examining Board Created. (a) There is hereby created the Electrical Examining Boerd ol toe City of Nappenee, Indiana, hereinafter designated as the Hoard,' which shall consist of toe Electrical inspector ol toe City of Nappanee, Indiana, and five (5) other members appointed by toe Mffljor as follows. One (1) representative of the electncai utility company serving the City: One (1) representative of the Class A licensed Contractors in toe City of Nappanee. One(1) Master Electrician, well versed on the Electrical Code (s) not associated with the Class A Contractor. One (1) representative from industry. One (1) representative from the public who is a private properly owner. (b) five (5) Board members be appointed for a term of four (4) yearn or until a successor is appointed. (c) The Electrical Inspector shall act as Chairman of the Board. Any appointed members may, for cause and after a hearing, be removed from office by the Mayor of the City of Nappanee. (d) Records of the meetings of the Board shall be open to the public for inspection at all reasonable times. The Board shaU keep a record of all licenses and certificates issued by it and shall have printed a manual of its rules and regulations for the conduct of the electrical examinations. (a) There is hereby created a Board of Review and appeals which shall consist of toe Mayor, or the Mayors designated, who shall be toe chairman, and the five (5) members of the Examining Board other than the Electncai Inspector. Each member of this Board shall serve without pay and until the member has been removed from office by the Mayor and a successor has been appointed. SECIfoN 6. Duties and Authority of Electrical Examining Board. (a) The first Monday of January, April, July, and October of each year are hereby designated as electrical examination dates for the examination of applicants for electrical licenses providing any such applications are pending. No licensing examinations shall be given on any other dates without the approval of a majority ol the members of the Board. (b) It shall be toe duty of said Board to examine the reports ol persons, firms, or corporations who apply for licenses to examine and grade all license examinations within seven (7) days of toe date such examination is given, to approve issuance of electncai tioansa to qualified applicants who have paid the prescribed toes, and to revoke or suspend any etootrical ficanee on toe grounds

(3) The dwelling is a detached building containing no other dwelling unit or other occupancy. (4) There are no other buiktings, other than the dwelling and accessory buildings located on toe premises. (5) No more than one permit has been issued to the same person in the preceding thirty-six (36) calendar months. (6) Al work shafi be done by toe owner. (7) The owner files wito the Electrical Inspector an affidavit stating al of the foregoing facts. SECTION 10. Classes of Licenses. One (1) class of license and certificate therefore shall be Issued by the Board, which shall be known as a Class A, Electrical Contractor's License. A Class A license shall entitle the holder thereof to undertake to execute or perform any work of Installing, maintaining, altering or repairing electrical equipment. SECTION 11. Fees for Licenses and Expiration. Any person applying for a Class A license, u required by tois Ordinance, shall before being granted a license, give, execute and deliver a surety bond to the City of Nappanee, in toe penal sum of Five Thousand Dollais ($5,000.00), to be approved by the Common Council and conditioned upon the faithful compliance with the ordinances and laws regulating electrical work. upon approval of the examining Board, the Electrical Inspector is authorized to issue said license under the provisions of this Ordinance. Before a license is granted to any applicant, a license fee of One Hundred Dollars ($100.00) shall be paid for a Class A license, and before a Class A license is renewed, a fee of Fifty Dollars ($50.00) shall be pax). Each license shall expire on December 31 following the dale ol its issue and shall be renewed upon application of the holder of toe license and payment of the required fee. All licenses and bonds must be renewed on or before the date of expiration and any license becoming thirty (30) days delinquent, shall be Issued as a new license with all requirements of same. SECTION 12. Application tor Licensee. Each application for a license shot be made in writ(3o) days before toe examh nation date, stating the Class of license applied tor, and the name and place of business of the applicant. A nonrefundable examination fee of One Hundred Dollars ($100.00) shall be paid when application is made. A nonrefundable fee of Two Hundred Dollars ($200.00) shaU be paid when application is made for a special examination that may be

.connected within or on any building structure or promises pubfidy or privately owned, nor shal any attention or addition be made in any existing equipment, without first securing a pennit therefor from the Electrical Inspector, of posting a certificate showing permit has been applied for within seventy-two (72) working hours of start of work and authorizing contractor to proceed with electrical instaUation. Application for such permit describing the work to be done, shaU be made in writing to the Electrical Inspector by the person, firm or corporation installing the work. Exception 1. SECTION 18. Feat. Before any permit to granted tor toe innate ton of electrical equipment, the parson, firm, or corporation making application tor such permit that pay a fee of Forty Mars ($40~00) hereafter referred to as a minimum fee or an amount derived torn the following foe schedute, whichever is the higher amount (a) Fees for electric service entrance, single phase or toree phase: 100 AMP Panel (2 inspect max.) $40.00; 200 AMP Panel (2 inspect max.) $50.00; 400 AMP Panel (3 inspect max.) $60.00; 600 AMP Panel (4 inspect max.) $70.00; 800 AMP Panel (4 inspect max.) $60.00; Additional Subpenels (each) $30.00; Temporary Service $30.00; (b) If any person, firm or corporation shall do any work covered by this Ordinance requiring a permit without first obtaining said permit, a penalty fee of Thirty Deters ($30.00) shall be charged In addition to the regular amount of the permit. Payment of such penalty shaU not release them from other penalties provided tor in this Ordinance and each day toe violation exists shaU be declared a separate offense. (c) It shal be a violation of this Ordinance for any licensee to secure a permit to do electocal work if too license holder does not intend to perform or inspect and supervise toe performance of such work. (d) Permit fees for electrical work done on the City of Nappenee municipal property tor the municipality of Nappanee andtor Its authorized agencies may be waived. Permits must be toe value of toe waived fee noted on the permit SECTION 20.. Inspqction and Certificates. Upon completion ol any installation of electrical wiring and equipment which has been made under a permit, N shal be the duty of toe person, firm or corporation making the installation to notify the Electrical Inspector. The Electrical Inspector shaU inspect toe instaUation within forty-eight (48) hours, exclusive ot Saturdays, Sundays, and Holidays, of too time such notice is given or as soon toereaflsr as practicable. Where the Electrical Inspector finds the instaUation in conformity wito the provisions of this Ordinance, too Inspector wiU then issue a certificate of approval, authorizing connection to toe supply of electricity and shaU send written notice of such authorization to the agency supplying the electric service. I, upon inspection, too installation is not found to bo in conformity with the provisions of this Ordinance, the Electrical Inspector shall at once forward to the person, firm or corporation making toe installation, a written

granted by the Electocal Examining Board as set forth in SECTION 6 of to» Ordh nance. In toe event the applicant finds through an unforeseen event, tois axaminetion cannot be taken, and at toast fifteen (15) days notice is given, the appficant may appear far toe next scheduled examination witiout an additional fee. If an applicwt fab to appear became of insss, toe appficant may, after providing substantiation of such iUnau, appear tor the next scheduled ex am nation without an additional toe. SECTION 13. Examinations. Tne person designated by toe applicant for a license shal be examined by toe Electrical Examining Board to determine too person's knowledge of toe rotes and regulations for toe installation of electrical equipment as set forth in this Ordinance, and in the National Electric Code (NEC, NFFA #7O), as approved by the American National Standards Institute (ANSI); and to determine toe general qualifications and fitness of the applicant for executing the class of work covered by the license applied for, provided that a person now holding a Nappenee license will be issued a like license without further examination, but by paying the new fee as set forth in this Ordinance. Each examination shaU be conducted by a person duly designated by toe Electrical Examining Board. A complete record of every examination given shaU be kept on file until three (3) years after toe dele of examination. Any person who cheats during any examination shall be conclusively presumed unqualified and unfit for licensing pursuant to this Ordinance, and in addition, thereto shall be guilty of a Class C infraction, punishable as provided under Indiana statutes covering such infractions, and shall be disqualified from holding any license or applying for or taking any future examinations for licensing by the City ol Nappenee as a Licensed Electrical Contractor. SECTION 14. Failure to Pass an Examination. Should an applicant fail to pass an examination by obtaining a rating lower than seventy (70), said applicant may be re-examined upon submitting application in writing at least toirty (30) days before the next examination date and accompanied vith the One Hundred Dolan, ($100.00) examination foe. SECTION 15. Holder ot License. As used in this Ordinance, toe term “holder of a license' shall be the person to whom the license is issued. A person may not hold more than one (1) license issued by the City of Nappanee at one time. SECTION 16. Change ol Representative. Any holder of a license Vtoo is performing or supervising the installation, maintenance, alteration, or repair of electrical equipment, or performing or supervising electrical work for a firm or corporation under SECTION 9 herein, whose employment with such firm or corporation shall terminate, shall immediately notify the Board of such terminations. Such firm or corporation shall provide to the Board, within ten (10) days of the date of such notice, written notice of the name and address of the license holder replacing such person. SECTION 17. Certificates. Each certificate for a license shall specify the name of the person to whom the license is issued, the name of the firm or corporation the holder is representing under SECTION 9 herein, the name of the person designated as toe factory representative, and the expiation dale. Every holder of a license shall keep the, their, or its certificate of license displayed in a conspicuous place in the holder's principal place of business. SECTION 18. Permits. No electrical wiring or equipment shall be installed or
