Notice of Public Hearing NOTICE OF DETERMINATION TO CONSTRUCT AND FINANCE IMPROVEMENTS TO NAPPANEE SEWAGE WORKS ANDOF A PUBLIC HEARING ON PROPOSED RATES „ ANDCHARGES Property owners and other interested parties in the City of Nappanee are hereby notified that on March 25, 1985, the Common Council adopted Ordinance No. 985, thereby determining to acquire and construct improvements to, and facilities for, the City's sewage works consisting of facilities to provide expansion of the ex i*ting wastewater treatment plant from a capacity of .9 million gallons per day to 1.9 million gallons per day, together with other necessary equipment, structures and appurtenances, and shall be acquired and constructed in accordance with the plans and specifications prepared by Commonwealth Engineers, Inc., engineers of Greenwood, Indiana. The cost of the improvements estimated by the engineers in *5,667,655. Ordinance No. 985 further determined that the cost of the project, over and above estimated state and federal grants in the aggregate amount of *4,671,655 and funds on hand and investment income in tne amount of *126,000, be financed by the issuance of revenue bonds in the amount of *870,000, which bonds will be payable solely from the net revenues of the sewage works. The bonds will be sold at public sale pursuant to I.C. 5 1-11, at an interest rate or rates not to exeed 9V5 per cent per annum for bonds maturing through July 1, 1990; 10V5 percent per qn num for bonds maturing from July V 1991, through July 1, 1995; 11 percent per an num for bonds maturing from July 1,1996, through July 1, 2000, and 12 percent for bonds maturing July 1, 2001, through July 1, 2004, the exact rates to be determined by public bidding. A copy of Ordinance No. 985 may be examined at the office of the Clerk-Treasurer. Objections to said project may be filed in the time and manner provided by the Indiana Code, Title 36, Article 9, Chapter 23. Property owners and other interested parties in the City of Nappanee are further notified that Ordiance No. 986, establishing rates and charges for ser vices to be rendered by the sewage works, was introduced at the meeting of the Com mon Council held on March 25, 1985. At a meeting of the Common Council to be held at 7:00 p.m. (Nappanee Time), on April 15, 1985, in the Municipal Center, Nap panee, Indiana, there will be a public hearing on the matter of the proposed rates and charges, and consideration of adoption of said Ordinance No. 986, which provides in part as follows: (a) The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the same is measured by the water meter there in use, plus a base charge based on the size of the water meter installed, except as herein otherwise provided. For the pur pose of billing and collecting the charges for sewage service, the water meters shall be read monthly and the users shall be billed each month (or period equaling a month). The water usage schedule on which the amount of said rates and charges shall be determined shall be as

At such hearing and prior to final adoption of Ordinance No. 986, and of proposed Ordinance No. 987, regulating connection to and use of the sewage facilities, all interested parties may appear and be heard. Copies of the plans, specifications, cost estimates, proposed Ordinance No. 986 and proposed Ordinace No. 987, are on file in the office of the ClerkTreasurer and are available for inspec tion by any interested parties during regular business hours. City Os Nappanee Ordinance No. 985 An Ordinance concerning the construction of additions and improvements to the sewage works of the City of Nappanee, the issuance of revenue bonds to provide the cost thereof, the collection, segrega tion and distribution of the revenues of said works, the safeguarding of the interests of the owners of said bonds, other matters connected therewith and repealing ordinances inconsistent therewith WHEREAS, the City of Nappanee, Indiana ("City") has heretofore established, constructed and financed sewage works pursuant to Chapter 61 of the Acts of the Indiana General Assembly for the year 1932 (Special Session), and now owns and operates said sewage works pursuant to I.C. 36-9-23, as amended, and other applicable laws, (collectively, the "Act"); and WHEREAS, the Common Council ("Council") of the City now finds that said sewage works is in need of certain additions and improvements; that plans and specifications for said additions and improvements have been approved by said Council and by all governmental authorities having jurisdiction, particularly the Stream Pollution Control Council of the State of Indiana; and WHEREAS, the Council has advertised for and received bids for the construction of said additions and improvements; that said bids are subject to tne City's determination to constuct said works and subject to the City's obtaining funds to pay for said works; that on the basis of engineering estimates the costs of the works, as outlined in the Act, including estimated incidental expenses, is in the approximate amount of *5,667,655; and WHEREAS, the Council finds that a federal grant in the estimated amount of *4,156,025 and a state grant in the estimated amount of *515,630 will be made available for application on the cost of said project, and that use of funds on hand and investment income will provide *126,000 for the project, leaving a balance of approximately *870,000, to be financed by the issuance of sewaqe works revenue bonds in the estimated amount of *870,000 to be issued as hereinafter set forth; and WHEREAS, the Coulncil finds that said balance of the cost of said addition* and improvements cannot be provided for out of funds of the sewage works now on hand or to be received prior to the completion thereof; that funds to apply on the cost should be provided by the issuance of additional revenue bonds as set forth above payable solely out of the net revenues of the City's sewage works; and WHEREAS, the Council finds that said are now outstanding bonds issued on account of the construction and improvement of the City's sewage works and payable out of the revenues therefrom designated "Sewage Works Revenue Bonds," dated July 1,1961 ("1961 Bonds") now outstanding in the amount of *545,000, bearing interest at the rate of four and one-quarter percent (4-’/4 percent) per annum and maturing on July 1 in the years 1985 to 1996 inclusive, which bonds constitute a first charge upon the net revenues of the sewage works; and WHEREAS, the ordinance authorizing the issuance of the now outstanding 1961 Bonds permits the issuance of additional bonds ranking on a parity with the 1961 Bonds provided certain tests can be met, that the Council finds that such tests can be met, end, accordingly, the additional revenue bonds issued pursuant to this ordinance shall be on a parity with the 1961 Bonds; and WHEREAS, the Council now finds that all conditions precedent to the adoption of an ordinance authorizing the issuance of said additional parity revenue bonds have been complied with in accordance with the provisions of the Act hereinbefore referred to; now therefore, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF NAP PANEE, INDIANA: Section 1. That the City proceed with the construction of additions and improvements to its sewage works in accordance with the plans and specifications heretofore prepared and filed by Commonwealth Engineers, Inc., con suiting engineer, employed by the City, which plans and specifications are by reference made a part of this ordinance £s fully as if the same were attached hereto and incorporated herein and two copies of which are now on file In the office of the Clerk'TreaSurer of the City and are open for public inspection pursuant to I.C. 36 1-5-4, that the cost of construction of said additions and improvements shall not exceed the sum of *5,667,655 without further authorization from this Council. The terms "Sewage treatment works," "works," and other like terms where used in this ordinance shall be construed to mean and include all structures and property of the City's sewer utility, including items defined at I.C. 36 9-1-8. Said addi lions and improvements to the sewage works shall include facilities to provide expansion of the existing wastewater treatment plant from a capacity of .9 million gallons per day to 1.9 million gallons per day. together with other necessary equipment, structures and appurtenances, and shall be constructed in accordance with the plans and specifications heretofore mentioned, which plans and specifications are herby approved.
