ORDINANCE NO. 17 AN ORDINANCE RELATING TO PEDDLERS, HAWKERS AND ITINERATE DEALERS 4N GOODS, WARES AND MERCHANDISE AND PRODUCE, PROVIDING PENALTIES FOR VIOLATION THEREOF AND REPEALING CONFLICTING ORDINANCES Be it ordained by the mayor and Common Council of the city of Nappanee, Indiana, That: Section 1. It shall be unlawful for any person to engage in peddling, canvassing, hawking or -street vending \Hthin the corporate limits of the City of Nappanee, Indiana, any merchandise or article of value, without first having obtained a license so to do, said license to be issued by the City Clerk upon payment to him of the sum of seventy-five cents ($.75) for the issuance of said license together with a license fee of ten ($10.00) dollars for each day such license shall be in force. Provided that the above provision of this ordinance shall not apply t& wholesale traveling merchants or peddlers who sell only to resident retail dealers, in like commodities, nor to dealers in dairy products, nor to venders of produce and provisions raised by themselves in Elkhart County, Kosciusko County, Marshall County, or Saint Joseph County, Indiana. Section 2. It shall be unlawful for any person or itinerate dealer to sell or offer for tfale, barter or exchange any carload lot or less quantity of fruit, vegetables or farm produce, contained in any railroad car or in any freight depot or store house within the City of Nappanee, "Indiana, without first having obtained a license for that purpose as set out in section One (1) of this ordinance. Section 3. Any dealer, peddler, Itinerate merchant or person selling goods, merchandise, or wares and duly licensed shall not stop or park his or her cart, wagon, or vehicle-on any street or public place in said city to display or sell his or her .goods or wares except on the place herein set out. Parties that are engaged in the business as set out in this ordinance may park their carts or vehicles on Lincoln street from ‘the alley that runs parallel with Main street and Elm street to'the alley that runs parallel to Main street and Clark street.. Section 4. This Ordinance shall not apply to persons who are" exempt from the provisions thereof by either State or Federal laws. Section 5. If any provision or section of this ordinance shall be held void or unconstitutiohal for any reason, all other provisions and sections which are not expressly held void and unconstitutional shall be and continued in force and effect. The cost of improving street and alley intersections to be paid out of the general fund of said city.
