Jury Trials. A Kansas City paper has some very sensible ideas on the jury system. It says: "There is a wide-spread opinion that it is wrong to permit one man to hang a jury instead of eleven man hanging the accused. In a recent murder trial in this state eleven men stood for conviction from the first, while one man stood out for acquittal when a hung jury meant another long and expensive trial with the risk of a miscarriage of justice. The law should provide that at least three-fourths of the jury should decide the guilt of the accused. "When nine men, after hearing all the evidence in a case, where able counsel have done all the law allows to protect the accused and where a fair and impartial judge Bits on the bench to see that justice is done, have agreed that the accused is innocent or guilty, their opinion should decide his fate. It is wrong that the opinion of one or two men on the jury, an opinion which may be held for interested reasons, should outweigh and nullify the combined opinion of a three-fourths majority of the jury. If eleven men regard the evidence produced as conclusive one way or another, the accused is legally guilty or innocent, and the opinion of one more man cannot and should not be entitled to as much weight as the opinion of all the other members of the jury. When a man is on trial for his life he should be given the benefit and advantage of every protection. The law presumes him innocent until he is proven guilty, and it proceeds on the still further magnanimous assumption that it is better for ninety-nine guilty men to escape than for one innocent man to suffer. Uut the com

bined opinion of nine men is as safe to trust as the opinion of two or three

more, and all danger and suspicion of tampering with the jury is removed. One man should not by obstinacy or for any other of the reasons which fre

quently obtain, mock justice and make the honest verdict of eleven men go for

naught."
