Public notice is hereby giveni that the Common Council of the City of Ligonier in Noble County, Indiana, desiring to enter into a gas franchise, grant and contract with the Northern Indiana Public Service Company, did at a meeting of said Common Council on the 10th day of April, 1930, determine- the exact form in which ' said franchise, grant and contract is fio be finally adopted, which form s in words and figures as follows: | , - GGAS FRANCHISE

- This agreement, made this | day of { 1930, by and between the City of Ligonier in- the county of Noble, Indiana, acting by and through its Common Council, (hereinafter called the “Municipality”), party of the first part, and Northern Indiana Public Service Company, an Indiana, corporation, (hereinafter sometimes called the “Grantee”), party of the second part, Witnesseth: - Section 1. The Municipality hereby grants unto the Grantee, its successors and assigns, an indeterminate permit, franchise, right and privilege to lay, install, replace, renew, repair, maintain, enlarge, extend and operate in, along upon and under any and all of the streets, alleys, comnjlon‘s,x bridges and other public places within said Municipality within its present and ‘future corporate limits one or more gas mains, pipes, manholes, and all necessary feeders, service pipes and other appliances and structures for the purpose of supplying and furnishing gas to said Municipality and the inhabitants thereof and the \public,in general and all customers of the Grantee residing within or without the corporate limits of said Mu"}?nici—pality, for lighting, fuel and all other purposes. - including the right to transmit, distribute, manufacture, purchase, furnish, supply:and sel} gas within said Municipality and to transmit and carry the same through said mains and pipes to territory beyond said Municipality, without ’charg’e or license fee therefor and subject to all reasonable police regulations now or hereafter lawfully adopted by said Municipality, pertaining to the use of the streets and the’ location of said mains, pipes or conduits. : Section 2. In the installation, maintenance, renewal, replacement, extengion.and repair of said gas mains, Pipes, feeders service pipes, manholes,. and other apparatus and appliances installed by said Grantee hereunder, said Grantee shall obstruct the streets alleys and public places to such extent only as shall be reasonably necessary. Section 3. The Grantee may make all necessary excavations and openings in the streets, alleys and other ‘public places of the Municipality for ‘the purposes aforesaid and when making such excavations and openings shall, by signal, guards, barricades or otherwise protect the public from injury to persons and property, and shall save and hold the Municipality harmless from all damages, costs and expenses which the Municipality may be compelled to pay proximately caused by the default, carelessness, or neglect of the Grantee in the con-

'-struction, maintenance and operation of its system hereby authorized, provided the Municipality shall promptly notify the Grantee of any claim or suit. The Grantee shall restore all streets, alleys and public places opened by it for the purposes aforesaid, to as nearly as practicable the same order and condition as the same were in before such opening. Section 4. Upon completion of said system, Grantee shall use all reasonable diligence and precaution to furnish and maintain a regular, adequate, dependable and uninterrupted supply of gas for fuel and illuminating, purposes to said Municipality and-the inhabitants thereof, but Grantee shall not be liable for any damage occurring to said Municipality or any customer in consequence of any failure to supply gas at any time or times that such failure is without default or neglect on the part of Grantee or when such failure is due to strikes, storms, accidents, riots, acts' of the public enemy, delays of any common carrier, default of any - connecting utility, judicial process, acts of God, state or municipal interference, breakdowns or injuries to machinery, transmission or distribution system or necessary repairs, or other causes { beyond the control of said Grantee, its successors or assigns. Section 5 This franchise agreement shall constitute an indeterminate permit under and pursuant to the terms and provisions of the Public Service Commission law of the state of Indiana, and in the event of the repeal of said law, this franchise agreement shall extend for and during the term of fifty years from and after the date that the repeal thereof becomes effective. The gas to be: furnigshed to said Municipality and the residents and inhabitants thereof shall be of such quality and at such pressure and shall be sold at such rate or rates as may from time to time be shown on the schedule on file with the Public Service Commission of the state of Indiana, or in accordancé with the laws of the state of Indiana. In case of lawful change in the schedule of rates, the rate legally applicable shall thereafter be charged. Section 6 This agreement and al of its terms and -provisions shall inure to the benefit of and be obligatory upon the parties hereto and the successors and assigns of the parties and shall be in full force and effect from and after the date of its being approved by an ordinance duly adopted by said Municipality. If Grantee does not have in operation a distribution system within said Municipality within one year from the date of this contract takes effect, this franchise shall then terminate, but if the installation work is in progress at the end of said one year, this franchise shall remain in force and the Grantee ;shall finish the work within a reason“"able time. : .

P, DuWan of Kendallville Gets Copy of Proposal Listing Amounts For Provisions of the World War Pension bill which is sponsored hy Congressman David Hogg Fort Wayne were outlined by Charles P. DuWan state commander of the Disabled War Veterans of -Fort Wayne following the receipt by him of a copy of the bill which was referred to the House Committee on Pensions and ordered printed. = : - Commander DuWan points.out that disabilities received by ex-service men not drawing compensation and ‘unable to work because of them would bring a pension. not to exceed $62 or less than $lO a month, according to Rongress man Hogg's billf Those helpless or blind or so nearly so that the attention of another person is required should be given the rate of $72 a month. However no person should receive more than $3O per month while an inmate of a government ingtitution according to the provisions of the bill.. : To widows of ex-service men a pension of $3O a month should be given and for each child under 16 years of age an additional $8 . per month would go to the widow according to the bill. The children would draw the widow’s pension until 16 years of age should there be a death marriage or other forfeiture for the widow. Another important provision of the bill as outlined by Commander DuWan shows that no. person engaged in presenting a claim for the pension seeker can claim more than $lO as a fee for doing so. : ' o

Lafayette Crothers of York township republican candidate for county commissioner middle district had the misfortune to run broadside into a Pennsylvania freight train at the South Main street crossing at Kendallville as he was returning home trom the Wayne Center farm bureau meeting Wednesday night. : Faces Embezzlement Charge ’ Charges of embezzling $4,5600 from the First National bank at Peru have [been filed against Mrs. Willlam C. Cushman 32 of that city. ~ Mrs. Cushman employed at the Peru bank for 13 years came to Fort ;’Wayne and surrendered to federal authorities.

She walved preliminary hearing and was bound over to the federal court under $l,OOO bond. . ' ; Mrs. Cushman is alleged to have taken the money over a period of seven years. The shortages were discovered about a week ago. She is said to have taken the money to aid her former husband Carl J. Becker Peru. : ; ;

Portland Bank Closed

The Jay County Savings & Trust company at Portland falled to open Friday after Cashier Cylde Bechtold confessed to officials of the bank that there was a shortage of between $60,000 and $60,000. o

Another Indiana institution the Toth State bank of South Bend was turned over Thursday for liguidation to the (Citizens Trust and Savings bank following a meeting of 75 stockholders of the institution. Reports that the bank was to be closed had spread and police were sent to preserve order. : .

“Studebaker Tigers” to Reune

The 32nd annual reunion of the 157th regiment Indiana volunteer infantry better known as ‘Studebaker’s Tigers” will be held in South Bend on Sunday June 15 1930. Chaplain Chas. E. Medbury of Des Moines la, and members from all over the United States will be in attendance. The committee of Company F is planning on making this reunion the best in the history of the organization and invitations will be mailed in the near future to each member of the regiment. | ;

Elkhart Girl Kills Selt

' Emogene Swartz 22 ended her life Thursday afternoon by shooting hergelf in the mouth at South Bend. Miss Swartz was employed at the home of Willard Faught and was in her room at the home when she killed herself. Faught who was in another part of the house heard the shot and rushed into her room. He found her sprawled across the bed partially clad and her mouth was bleeding profusely. = :

Lad Lights Birthday Cake

‘A three year old boy was burned severely when his clothes caught fire as he was lighting candles on his birthday cake at South Bend. ~ The mother of _Geor%:D. Eryckere South Bend extinguished the burning clothes and took her son to a hospital His condition was reported as serious. George was lighting the third and last candle when flames touched his clothing as he leaned over the cake.
