Deifense Attorneys File Plea in Abatement Because Ralph Elder Member of Grand Jury Was Depositor
Things happened with rapidity in thec ase of the State of Indiana vs. Lloyd 8. Crouch in the Whitley circuit court on a charge of embezzlemert of funds of the Provident Trusa Company when the case was called Saturday morning with Special Judge Rex Emerick of Kendallville, presiding. 2 :
First the defense counsel C. A. Lincoln of Columbia City and Attorney McAdams of Fort Wayne entered a plea in abatement charging that one of the members of the grand jury that had returned indictmerts against Lloyd S Crouch in connection with the failure of the Provident Trust Company had been a depositor in-the bank. After granting a recess for Prosecutor Ralph Probst to file his answer, when the court re-convened Judge Emerick sustained the demur to the plea in abatement and the defendant, ICrouch was brought into court. : The reading of the indictment charging embezzlement was waived by the defense and Attorney C. A. Lincoln, for Crouch entered a plea of “not guilty.” . The court then attempted to arrive at a date for the trial to start. Attorney McAdams one of the Crouch’s counsel was located fn Fort Wayne and he suggested that the case be set for January 15th. Hijacker is Killed
Search was being made by police today for the liquor runners who shot and killed Wiilliam Kemple Jr., 28 Indianapolis former convict in a hijack battle at Bainbridge. Poliice believe the shooting occurred when Kemple and an unidentified companion attempted to rob an auto driver and two companions of 100 gallons of liquor. Two men in the liquor car fled immediately after the shooting. The auto carrying the liquor bore a title card and license plates which showed it to be the property of Morriis Davis Indianapoplis. :
