Gandy Fails to Show.
Elmer E. Gandy of Churubusco was to be in Huntington Friday to give himself up for a term in the stats prison. This was undeérstood following the ruling of Charles K. Lucas special judge on motion of the state to commit Gandy to prison. The mo tion was based on the plea that the defense has lost its right by not filing its appeal within a specified time ~ Recently the state made this motion before Judge Lucas and the court set arguments for Thursday. It developed in court that the defence had 90 days from last May 28 to file its notice and ninety days to perfect an appeal. The defense it seems has still an opportunity for an appeal and for providing bond for the defenidant. But there seems no way to prevent the defendant from going fo prison at thig time because of the delay in, the appeal. i At the appointed time Gandy failed to show up in court and his whereabouts are unknown. ;
