Wheat Contracts Held Good.
‘Actions brought by the Indiana Wheat Growers Association against Jacob S. Walters and Henry Mishler Elkhart county farmers on breach of contract and for injunction were dismissed in the circuit court Friday morning. The association had brought ‘the action against the two men to compel them to sell to the association more than 2,000 bushels of wheat under a contract which provided that the defendants were to sell' to the association their entire wheat crops, The actions were filed last December and since that time the defendants turned their wheat over to the association and the suits were dismissed as a result.
' The actions filed were the first tests of the contracts by which mem, bers of the co-operative marketing association are bound to deliver their crops to the association. et —— New Trial Asked In Damage Suit. A' motion for a new trial in the case of Mrs. Ruby Zimmeman of near Nappanee against Wilyard H. Gwin in which $lO,OOO was asked for alleged damages as result of an automobile accident which occurred in Nappanee October 11 1924 was flied in the Kosciusko circuit gourt Wednesday by the plaintiff. ~ 'The jury brought in a verdict in favor of the defendant Wilyard Gwin, Attorney Brubaker kin his motion beq fore the court alleges that the jury, did not give proper consideration tg the evidence as introduced .by : the lplaintiff and asks for a new trial.
Omitted Taxables.
The board of review over in Kosciusko -county has discoved that in Jackson township (that county),alone there is g difference of 665 cattle that were_ not on the tax list. This discrepency was discovered by the number tested for tuberculosis and those turned in for assessment. : .Not only cattle but diamonds and jewelry were en the missing list. In 1925 one township had $83,255 in 1926 only $18,320. A number of townships are being <alled upon the carpet to explain. .
Takes His Fine C(ooly.
Dich Matchett of Bourbon was given a fine of $lOO and thirty days in St. Joseph county for the possession of intoxicating liquors. The jailg sentence was suspended. The case was venued from Marshall’ county. Dick Matchett was a son of Doctor Matchett who formerly practiced medicine in New Paris over fifty years ago. : .
Sentenced to Farm.
_'Chancey Tarman of New Paris was sentenced to thirty days at the state penal farm and fined $5O and costs by Judge James S. Drake in juvenile court ‘Friday morning when he pleaded guilty to a charge of contributing to the delinquency of a minor. Tarman was to have been tried by a jury but changed his plea to one of guilty.
Attends Concert. .
Elias C. Wilson accompanied the Tri-City band to Ligonier on Wednesday joined the band proper making a total of twenty musicians presided over by George Roscoe as manager, Elias, was highly pleased by the entertainment and reports a large attendance.—Goshen Times.
Finds Hidden Money.
Ralph Weaver of LaGrange while putting new shingles on an old house in which he lived found a cloth belt containing $l2O in $5 $lO and $2O gold pieces. The oldest coin was dated 1825 Herman Haskins owner of the house permitted Weaver to keep the money.
