In the Steu ben circuit court a motion has been made for a permanent injunction restraining the tréasurer from collecting any takes on the so-called omitted property. JudqbrMchide held that the auditor had the power to place property on the duplicate, for the years 1881, 1882, 1883, but mnot prior to that time, and that for such years the taxes must be paid. It was algo decided that the .auditor had 1b right to increase the valuationiof property once assessed, and that in cases where this had been done the idcreased tax could nct be collected. !
