mit bids on the improvement of a threc-in.le fstretrn 01 hignway on tiie county line between Montgomery nod Boone counties. The Boone county commissioners were in Craw ford lillc, to join :th the Montgomery board in letting the contract. They rotumed to 1-ebanon when they learned no bids had ben submitted. The increased
cost of material caused the failure of
contractors to bid on the work, the jump in prices having occurred since the engineer's estimate on the job made. The difficulty in letting the contract
j for the proposed improvement follow
a lonir litigation through three courts. The issue presented in the fight for and against the improvement of the road was an entire!) new question in Indiana and the authorities had no precedent upon which to base their action. Whether or not a bridge upon a highway is to be considered a part of the highway was the question at issue, remonstrators against the improvement basing their opposition on the. grounds that the rnmmisioocrs had no right to order a road improvement under the three-mile gravel road law that would include the construction of an expensive bridge. The commissioners Tuled that the bridge was a part of the road and its construction should be a part of the load improvement. When the reinnn.it rators took the nutter to rirmit court. Judge West made the same ruling tiiat Ue commissioners had made. Then the r;i.- was appealed to the supreme court and the ruling made by Judge West was affirmed.
