WISER HOT TO ARGUE WITH
THE JUDGE TO SOLVE
f! NT R NATIONAL NEWS SERVICE! . ATLANTA, Ga., Dec. "Don't arsue with the Judge it's costly business." This bit of priceless advice was voiced by Attorney Arthur Ifeyman, who by an apology in court to Judge John Humphries saved himself from a term of twenty days in jail or a fine of j:00. aiivjctd iiffrai.t.cn of ourt rules came In the casa of Elmer Oliver, former,, president of the t 'liver Rim Company, who was befcig tried on a charge of einbezxi ent of rr.crt ii.au fldO.GCa of the company's funds. The verbal tilt between the attorney who represented Oliver and tho court followed a ruling made by Judge Humphries in permitting certain evidence involving a Jl,50 0 transaction Oliver was said to have made while president of the rim company. "They are trying to hatch up ,this item, which never before has been included In the charges," Attorney Ileyman told the court. He attempted to read-records concerning previous testimony, but was interrupted by tho Judge. . "You needn't read that," the judge said. "I am familiar with what has been testified." "Then do you propose to charge Mr. Oliver with this Item?" "No; I'm not charging him with anything." the Judge replied. "'This charge Is " began Ileyuian. "Xow Mr. Ileyman, you hush up and sit down, or I'll send you to jaiK" was the judge's warning. "All right, certainly," replied the attorney. "Mr. Sheriff, collect J100 from
Mr. Ileyman, or keep him In Jail I ten days!" the court said. "I am !
Mirnris- d that a lawyer c-f your t-tandlng. should insist upon maintaining a disrespectful attitude. The fine must be paid, or you must accept the alternative. That's linal. If I can't keep good order I would not be worthy of presiding over th court." "I am also surprised at your attitude." Ileyman replied, "I am going to give you another $100 or another ten days'." Judge Humphries said. "I won't pay It," announced the lawyer. "I'll go to Jail first!"
Later Heyman apologized to the court and asked that the sentence be revoked. Judgo Humphries removed all of the fine but which the attor ney promised to pay. I
