(3) Said pipe lines shall be so laid and maintained as not to interfere with the use of said highways or streets, or the repair and maintenance thereof, and so laid and constructed as not to interfere with the drainage of high-

I ways, streets or alleys, and in crossing drains, streams, sewers or city water pipes, lead or mains, said pipe lines shall be so placed above or below the same so as not to obstruct the usv2 of the same. WhTever said pipe lines are placed under the surface of side walks or improx-ed streets or road beds, the side walks, street Improvement or road b:ds which may be torn up or disturbed shall be restored to the same degree of repair and condition with the same degree of durability, usefulness and safety for travel and otherwise as before the same was torn up or disturbed. (6) In the event the city should widen any of Its streets over which said grant is riven, or tt should become necessary for said city in improving: its streets and alleys, or sidewalks, or in laying: water mains, or in changing the grade or sewers, or in changing- the grade, require the elevation or depression, or removal from one part of the street to any part of said grantee's pipe line or lines, the city shall have the right to require such depression or removal by said grantee. (7) Said grantee agrees to keep and maintain Its pipe line or lines In safe condition and to make immedate repairs In the event of leaks or injuries to Its pipe or pipes. () Said grantee shall be responsible for all damages resultingfrom negligence or want of proper care and properly g;uardingr and protecting the public streets and alleys during construction or repair work upon said system, and also for any damage resulting: from any cause In operating and maintaining the said system. (9) If the grantee herein shall neglect or fail to construct, and put in operation one pipe line over and along: such parts of the lines herein described, as It may require, within three years of the date of this franchise, all rights hereunder shall cease and this franchise shall be void. (16) That before proceedingwith the Installation or construction of the said pipe line or lines. as hereinbefore provided, the said corporation or Its grantee, success or or assignee shall procure and file with the City Clerk of the said City of East Chicago, after approval y the Mayor thereof, a bond, upon good and sufficient surety, in the p:nal sum of One Thousand ($1,000) Dollars to the said City of East Chicago, indemnifying and saving harmless tbe said City of East Chicago from and against any and ail liabilities claimed or alleged against it arising from or by reason of any and all damages caused by the construction, installation, operation or maintenance of the said pipe line or lines system. (11) That this agreement, contract and grant shall take effect from and after its confirmation, adoption and ratification by the Common Council of the said City of East Chicago, upon compliance with the requirements of the statutes of the State of Indiana in such case made and provided and the acceptance in writing by the Sinclair Pipe Line Company and for the period allowed by the terms of this contract to-wit: Fifty Years, but if said Company shall cease to operate said pips lines for a period of three years, the rights herein granted shall terminate.
