THE GRAND JURY'S TASK. There is only one construction to put upon Pros. Atty. Kinder's action in refusing to nolle prosse the cases in the Gary City court last week. He knew the grand jury had been called by Judge Martin Smith for the purpose of hearing the evidence regarding wholesale law violations in Gary ond other parts of Lake county. The prosecuting attorney didn't show any sympathy with Judge Smith. It seems as if he sought to head-off the evidence by summoning the reporters into the Gary city court. The Times had gone to a good deal of risk and expense to obtain the evidence. Had Prosecuting Attorney Kinder whose duty it was to enforce the law sent the police to raid the resorts he would have had more evidence than the reporters obtained. It is apparent Kinder was not looking for evidence. It is as plain as the nose on your face. If it hadn't been for Attorney McAleer Times reporters would be telling their story in the city court of Gary to a jury selected by Kinder and the grasd jury vould be twiddling its thumbs. Kinder's refvsal to nolle prosse the cases and his refusal to ask the city court to continue them was evidence enough of his unfriendliness w d.e grand jury and Judge Martin Smith. True enough, after McAleer had called Kinder a liar, :he prosecutor didn't object in open court to a continuance. He left that to Judge Dunn. And to the everlasting credit of the city judge of Gary Judge Dunn granted a two weeks continuance and showed that he, at least, had nothing to fear from the grand jury. These facts are restated to keep the record clear. The Times wants the public to know that it cannot help be suspicious of the prosecuting attorney. On the other hand it has the greatest
respect for Judge Smith and for Deputy Prosecutor W. 0. Thomas. What goes on behind the doors of the grand jury t Crown Point is known only to the jurors, the state and the witnesses. The grand jury very fortunately is composed of upright, lawabiding, intelligent and reputable citizens of the county. It will be guided by the facts. This
editorial is not intended to in any way prejudice
the jurors. It is a patriotic duty that the grand jurors are doing for Lake county. Taken from their private business interests these honorable citizens will no doubt spend many hot summer days in a jury room. If they thought of their personal interests or their personal comfort they would be tempted to go through with the task as soon as possible. But, judging by their reputations, it is to be presumed that they fully
realize the great public service they have been-
called upon to perform and that they will spare no effort to do it justice. There is law in Lake county. There are law-abiding citizens. The grand jury at Crown Point represents both the law and the law-abiding citizens. Whom does Prosecuting Attorney Kinder represent?
AN IDEAL SUMMER Summer will begin today. Possibly it will be an ideal summer. There never has been one, so the laws of chance ar in favor of an upset. An ideal summer would have a temperature sliding from 60 at dawn to 72 at noon, with clear air, bright sunshine and only those showers which are necessary and do not interfere with picnics. It would see the beaches without a swimage, or the discovery of a new germ, and a .reduction of 50 per cent in the cost of ice cream. It would be a summer when sport produced a super-Ruth, a better-than-Dempsey and another Man o' War. tl would see the beaches without a swimmer's cramp and the roads without an automobile tragedy. There would be sea serpents, but no sharks except a new and toothless variety. It would be a summer of absolute silence on the part of divorce principals. It would be a summer without a harsh word. But there the toe stubs. There is a Congressional campaign on. , Well, let the new season be as ideal as it can.
