WHEREAS, the Railway is the owner of a pole line located and extending in and -upon the streets or public -highways known as Standard Avenue from the Indiana-Illinois State Line to Calumet Avenue and south in and upon Calumet Avenue from ' Standard Avenue .to Ridge Road, and southeastwardly ill and upon Ridge Road to Forsythe Ave nue and north in and -upon Forsytne Avenue to Summer Street in said City of Hammorvd. and the Electric Company owns and operates an electric power distribution system along and upon said pole line of the Rail way and from which said Railway purchases and receives all electric power used by it In the operation of its railroad, and WHEREAS, said city has determined that public convenience and necessity requires the vacation of that portion of Ridge Road extending east from Columbia Avenue and occupied between Columbia Avenue and Forsythe Avenue by said pole line and electric distribution system and has requested said Railway and said Electric Company to surrender their rights in, along and upon' such portion of said Ridge Road and to remove said pole line and electrical distribution system from Ridge Road between Columbia Avenue and Forsythe Avenue to the street and public highway known as Locust Street extending from said Columbia Avenue to said Fosythe Avenue, and It therefore becomes necessary to provide said Railway and said Electric Company with a franchise, or permit, to occupy said Locust Street with their said pole line and electrical distribution system from the west line of Columbia Avenue eastwardly to the east line of Forsythe Avenue; NOW, THEREFORE, In consideration of the premises this agreement WITNESSETH THAT: Section 1. Section 2. In the setting of poles or In the maintenance or repair thereof the Grantee shall obstruct as little as possible the said streets of said City and may make all necessary excavations and openings in said streets for the purpose aforesaid, and when making such excavations and openings it shall by signal and otherwise do all things necessary to protect the public from injury and shall hold the said City of Hammond harmless from any danage or costs which said City may be compelled to pay as the result of any default, carelessness or defect of either of the Grantes in the construction, maintenance and operation of said electric distribution system and pole fline hereby authorized, rroided said City of Hammond shall not itself in such instance be guilty of contributory default, carelessness or negligence and shall immediately notify the said Grantees of any claim or suit. The said Grantees shaill restore as nearly as practicable all streets which shall be opened by it for the purposes aforesaid to the
same order and condition in which the same were before opened by them. In case the said Grantees after ten days written notice from the Board of Public Works of said City shall fall to restore that portion of said street opened by It to as nearly as practicable as good a condition as the same was in before it was opened, then the said City of Hammond may restore the same and recover the cost and expense thereof from the Grantees together with reasonable attorney's fees. Section 3. Said Grantees further agree to carry their wires at a sufficient height above the grade of said streets so as not to interfere with the ordinary public travel ' therein and to keep and maintain their said pole line and electrical distribution system in a safe condition and so as not to endanger life and ,property wih!n 8aid City more than is reasonably ipracticable in the operation of its system. Section 4. Said Grantees further agree to conform to all reasonable

Be it ordained toy the Common Council of the City of East Chicago, Indiana, that it shall be un lawful for any person or persons to to own, keep or harbor, any animal of the dig species within corporate limits of the City of East Chicago, without halving first obtained a li cense there for, as has been hereto fore, or may hereafter be provide! by the ordinances of said city and any person who shall suffer or per mit any animal of the dog species to frequent or remain upon his premises, or within his or her home, building or inclosure, or who shall feed, lodge or otherwise maintain or retain such dog, shall be considerei as harboring the same. Section 2. The Chief of Police of the City of East Chicago shall keep, operate and maintain for and in behalf of said City, a dog pound for the impounding of dogs, at a con venient place within the corporate limits of said City. It shall e the duty of said Chief of Police and the policemen of slid City to arrest take up, and Impound therein any and all unlicensed dogs found running at large in said City, and while so impounded, he shall provide said dogs with sufficient food, water and shelter. " Section 3. The - Chief of Police shall keep a record of all dogs 1mpcunded. giving the sex, color, breed, date of arrest and the name of the owner, if 'known. Section 4. Any person being the owner or keeper or entitled to pos session , of any Impounded dogs may redeem and take possession of the same upon payment of the proper fees and charges hereinafter provided, at any time within four days after the arrest and impounding of such dogs, and any perjron may redeem or be entitled to the possession of an impounded dog at any time after the expiration of the first day of such dog's impounding and before the expiration of the four day limit as herein provided by the payment of the fees required by the orflf"i nance. Section 5. Whenever the Common Council or thevMayor of said city shall apprehend that the disease of hydrophobia is in danger of becom ing prevalent in said city, such city ec'uncil may by resolution direct the Mayor, or the Mayor acting upon his own volition, may issue a proclamation ordering and requiring all persons owning or harboring any animal of the dog species to confine the same by good and substantial means in and upon the premises where such person may reside, for a period of not less than sixty days nor more than one hundred and twenty days ensuing the date of such proclamation, and upon the issuing of such proclamation by the Mayor, it shall become the c5uty of all persons owning or harboring any animal of the dog species to confine the same upon his or her premises and so as to prevent the same frOm being bitten by other animals, or cause the same to be securely and carefully muzzled by a good and sufficient muzzle. It shall be unlawful for any person owning or harboring any animal of the dog species to suffer or permit such animal to run at large without the proper muzzle herein required during the period of time specified in such , Mayor's proclamation. It shall be the duty of the Chief of Po lice and the policemen of said city : to arrest, take up and impound any and all unmuzzled dogs found run ning at large in said city during the period of time specified in such proclamation, and that such dog shall e impounded as Is herein required, for the taking and lmponding of unlicensed dogs.
