AGREEMENT. THIS AGREEMENT, mad ml entered Into by and between The East Chicago Company, a corporation, created, organized and existing under and by virtue of the laws of the State of Indiana, and hereinafter referred to as the corporation, party of the first part, and the City of East Chicago, Indiana, by and thru its Board of Public Works, John Eochnowskl. M. J. Kleman, Karl D. Norris, party of the second part, WITNESSETH: THAT WHEREAS, the said Board of rublic Works is, by the several statutes of the State of Indiana in Buch case made and provided, vested with the power and authority to order and contract for the erection and construction of worka for the collection, treatment and disposal ci sewage, and to lay out. design, order and contract for the construction maintenance of all public drains and sewers within the said City of East Chicago; to license the making of excavations in or the removal of rock, gravel or other material underneath the surface of any street, alley or other publia place in said . City; to prepare a general plan for the drainage and sewerage of said City and to extend the same from time to time and provide for the disposal of sewerage, and to drain, at the owner's expense, any lot or tract of ground wltUln said City whenever the water therein has or may become so obnoxious as to be or become injurious to the public health; and WHEREAS, the aaid corporation is the owner of that piece or parcel of ground known and described as the North one-half of Section Nineteen (19) and the South one-half of the South half of Section Eighteen (18) all in Township Thirty-Seven (37) North, Range Nine (9) West of the Second Principal Meridian in the said City of Hammond. County
of Lake, and State of Indiana; and WHEREAS, the Board of Public Works of the City of Hammond, Indiana, after investigation and examination of the said piece or parcel of ground be tor King to the s-t1 corporation, and tereinbefcre described, and of the surroum'Inic sn-.l pdlacent territory, liaa determined that it Is necessary for the health and general welfare of the, paid City of Hammond that a system of drainage or sewerage from the said ground hereinbefore rer ferrd to, and from the contiguous and adjacent territory be constructed, installed, malaiained and operated; and WHEREAS, the land owned by the said corporation is immediately adjacent to the western boundtry of the corporate limits of the City of East Chicago, Indiana, and j ' the Board of Public Works of the said City of East Chicago has also Investigated and examined the said property, as well as that in the near vicinity thereof lying and being in the corporate limits of the said City of East Chicago, and finds and determines that it Is necessary for the health, sanitation and general welfare of the said City of East Chicago that a system of drainage or sewerage from the said ground hereinbefore referred to and from the contiguous and adjacent territory be constructed, installed, - maintained and operated; and ; WHEREAS, the said corporation in view of such future uses and purposes as those to which the said, ground, hereinbefore described and owned by it, may be put, la desirous of having a certain, sufficient, dependable, safe and lawful means, method and Instrumentality of and for conveying and carrying from, removing and draining water In whatever quantity It' may come, be brought or accumulate upon the said ground away therefrom. In a satisfactory and lawful manner, as well aa for the purposes hereinbefore mentioned in: tnnectlon with ' general sewerage nd drainage; and WHEREAS, the said corporation, cognizant of the premises as hereinbefore set out, agrees that the said system of drainage or sewerage as referred to should be so constructed. Installed, maintained and operated, and in view of all the said facta and further consideration of having such system of drainage . or sewerage constructed and installed promptly, properly and safely has, and by these presents does, agree to so Install and construct the sam at its own expense, without delay, as soon as the industrial development of the said ground, as oontemplated by both parties hereto, has progressed sufficiently to permit, practically, efficiently and properly, the lotallatlon ef such drainage or sewerage system from the said ground as thus developed. NOW THEREFORE, It is agreed and understood by and between the tartles hereto (1) That the aaid system of drainage or sewerage shall be constructed, installed, maintained and operated by the said corporation, at its own expense, along and upon the following route in the said City of East Chicago, Indiana, after following thereto the route heretofore ordered, prescribed granted and permitted In the City of Hammond, Indiana, by the duly elected, qualified and acting Board of Public Works of the said City of Hammond, that is to say, along, under and upon such parts or portions as may be required for the purpose, of that certain highway, thoroughfare or street lying within the corporate limits of said City of East Chicago, known and described as White Oak or Knotts Avenue, and bounded on the north by the center line of 149th Street in the
said City of ESast Chicago, on the
west y the center line of the said White Oak or Knotts Avenue and on the south by the south line of 131st Street, in the said
City of East Chicago, together with those portions of 150th and 151 st Streets, in the said City, for

eaid White Oak or Knotts Avenue (and also, If required, the por
tions of said 150th and 151st Streets extending - fifty feet east
of the cast line of the said White Oak or Knotts Avenue), and

times operate and maintain the said drainage or sewer system in such way as not to interfere with any drainage, sewer or water pipe which may hereafter be located upon, along or across the streets, or alleys Intersecting the said roue, nor to Interfere with any of the said drainage, sewer or water pipes which are, or may hereafter be constructed along, over, or across said route by said City, or by any other person or corpor
ation, or by the Government of t
the United States. (3) That the said corporation further agrees that if at any time In the laying or construction of any sewers, drains or water pipes, the said sewer system shall be found to Interfere with the same, then the first party, its successors and assigns, will cause the said sewer system to be raised or lowered, as expeditiously as possible, as the said City may demand, upon thirty (30) days' notice in writing by said second party to said first party. (4) That the said corporation further agrees that when said sewer system shall be constructed and in operation there shall be permitted the connection therewith and the use and advantages thereof by the ownecs of the real property abutting upon th-se portions of the said White Oak or Knotts Avenue in said City of East Chicago, Indiana, where the said system of drainage or sewerage la, by these presents, ordered, prescribed and. authorised to be installed, constructed, maintained and operated In the same manner, method and form and to the same extent in all things as they might or could do In connection with the use or enjoyment by them of any other drainage or sewerage system In the said City of East Chicago, and upon such terms and conditions as to the construction of such connections as may be ordered and deemed proper by said second party by and thru Its then Board of Public Works. (5) That the said corporation farther agrees that It, Its successors and .assigns will maintain the said sewer system In such a way as may be reasonable and proper, making good at Its own expense all damages which may be caused to the surface of the land on account of the construction, maintenance and repair of said sewer. () That tne said corporation further agrees that It will construct said sewer system of reinforced concrete or equally as good material, and the same Is to be not less than three (3) feet underneath the streets and alleys hereinbefore mentioned. (7) That the said corporation agrees that said sewer system shall not exceed, on the Inside cross section, twenty-five (25) feet In width, by twelve (1J) feet In height, or a structure of equal cross seotlonal area. (S) That, for Its part, for and In consideration of the sum of One Dollar, to It In hand paid. tb knowledged; of all the premises hereinbefore and hereinafter expressed: of the tise by it of the

tained as hereinbefore agreed, under and along the highways, thoroughfares and streets hereinbefore mentioned, and across) them at their points of Intersec
tion with each other any other streets or alleys that now are or j hereafter may be in use aa public thoroughfares, streets or alleys, and hereby agrees to and does sanction, authorise and permit such Installation, construction, maintenance and operation. (9) That the easement, right, authorization and permission granted, given and conveyed by the said City of East Chicago to the said corporation by subparagraph (8), above, shall inune to the benefit of the said corporation, the said East Chicago Company as the owner of said property hereinbefore desorlbed. and to its grantee or grantees, successors and assigns. (10) That . before proceeding with the Installation or construction of the said drainage or sewer system, as hereinbefore provided, the said corporation or Us grantee, successor or assignes shall procure and file with the City Clerk of the said City of East Chicago, fitter approval by the Mayor thereof, a bond, upon good and sufficient surety, in the penal sum of Twenty-Five Thousand (125,000.00) to the said City of East Chicago, indemnifying and saving harmless the said City of East Chicago from and against any and all liabilities claimed or alleged against It arising from or by reason of any and all damages caused by the construction. Installation, operation or maintenance of the said drainage or sewerage system. (11) That this agreement, eontract and grant shall take effect from and after its confirmation, adoption and ratification by the Common Council of the aaid City of East Chicago, upon compliance with the requirement of the statutes of the State of Indiana in such case made and provided, and for the period allowed by the laws of the said State. THIS AGREEMENT Is executed in duplicate. IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and seals, this 27th day of March, A. D. 1922. THE EAST CHICAGO COMPANT.

WHITING LEGION SHOW TOMORROW NIGHT Tomorrow night will see the third performance of WhitingTs Legion
show "Behind the Lines." The de- .
mand for tickets for this final performance has been steady and the Indications are that a full house will greet the boys when they.show at the Community Center tomorrow evening. People have not seaced talking about the two performance sal ready given. Among those wlio havo been specially complimented on their part in the show are Harry Powers and Jimmy Lapert for their parts as the French vamps. Lapert also has been given much credit for hla part as the French peasant. Taul Mlhalso who takes the part of the Captoln's orderly, mail orderly and "bugler has also been given much credit. The singing of John Muprhy. as well as his part as Pete Mills, were favorably commented on, and those that will attend tomorrow evening will surely appreciate his work. The Legion's stellar quartette consisting of Murphy, Smith. Hornet and Beaublen, has created much enthusiasm and those who have heard them are loud In their praises. Much of what is necessary to put on a show is not visible to the audience. Those who came to see the show on the first and second performance were surprised at the seen ery. This was the work of the looal boya, A. K. Studebaker, Koeniff. Daugherty and others. Frank Lauer, as property man, has had his hands full, especially looking after Lillle the goat and Pat Griffith as general overseer and playing the part of Wildfire" has tbeen a busy bird.
