AND PROVIDING FOR A SCREENING OF CEMETERIES ALONG THE STREETS ADJOINING THERETO, HERETOFORE LOCATED IN THE CITT OF HAMMOND. INDIANA. SECTION. 1. BE IT ORDAINED by the Common Council of the City of Hammond, Indiana, that It shall be unlawful for any person, persons, firm or corporation, to locate anj cemetery within the City's limits) of the City of Hammond, Indiana, without first obtaining a permit from the Board of Public Works of eaid City so to do. SECTION 2. Any person, persons, firm or corporation desiring to establish or locate any cemetery within the city's limits of the City of Hammond, Indiana, as provided ifi Section 1 of this Ordinance, shall first file a written application with The Board of Public Works of said City, stating specifically the location of the proposed cemetery, giving the exact legal description of the ral estate to be used as such cemetery, and the number of acres therein contained, and file a plat of such proposed cemetery showing the landscaping of said proposed cemetery, together with the screens to be erected along the street In said City adjoining said proposed cemetery. SECTION 8. That after said application has been so filed with the Board of Public Works, as provided for In Section 2 of this Ordinance, the Board of Public Works shall fix a day for hearing eaid petition ind cause a notice to be published once each week, for two weeks. In any dally newspaper published In said City, stating the date that said petitions to ba heard before said Board of Public Works, so that anyone interested, or would likely be affected by the location of said cemetery, can file objections to the location of said cemetery and after hearing on said matter, said Board of Public Works may grant or reject said petition. SECTION 4. That If said Board of Public Works should act favorably on said petition, and before said permit Is granted, said Board of Public Works shall require of eaid petitioner or petitioners, to enter Into a written agreement with the City of Hammond, that said proposed cemetery to be so located, shall T,e platted, landscsfper and filled in and planted with trees and shrubbrey along all streets and public highways adjoining said proposed cemetery. In accordance with plat tiled with said petition, as hereinbefore provided In this Ordinance, and to give a bond for the faithful performance of said agreement, said bond to be not less than Ten Thousand Dollars ($10,000.00) and approved by the Board of Public Works, and said agreement to be ratified by an Ordinance passed by the Common council of the City of Hammond, Indiana. That if said permit for the location of said cemetery be granted by aid Board of Public Works, then the petitioner or petitioners are to pay all the costs occasioned by the filing of asid petition and the publication of notices, as hereinbefore provided for In this Ordinance. SECTION E. That it shall be the duty of all persons, firms or corporations, owning or controlling any cemetery heretofore established In the City of Hammond, Indiana, to erect screens by planting trees and shrubbery along the streets and high ways adjoining such cemetery heretofore established, and to file with the Board of Public Works (of said City, a plan, plat and speclHcations showing the proposed plan for landscaping and filling in and planting with trees and shrubbery along all streets and public highways adjoining said cemetery heretofore located in said City, and to give a Bond for the faithful performance of said agreement, said Bond to be not less than Ten Thousand Dollars ($10,000.00) and approved by the Board of Public Works, and said agreement to be ratified by an Ordinance passed by the Common Council of said City of Hammond. Indiana. SECTION 6. That said Board of Public Works may approve said plan, as In Section 5 provided, or reject the same, or make any modifications said Board may see fit and proper, and the Board of Public Works shall Issue a permit to said owner or owners, or anyone controlling a cemetery heretofore' established, to erect said screenings, and the same shall be constructed under the supervision of the Board of Public Works. SECTION 7. Any person, persons,
firm or corporation violating any part or portion of this Onjianoe upon being found guilty, shall be lined In any sum not exceeding Two Hundred Dollars ($200.00.) SECTION 8. That any Ordinance or parts of Ordinance heretofore passed by the Common Council of the City of Hammond, Indiana. In conflict with this Ordinance, are here by repealed. SECTION 9.
