They were married May 18. 1921 and separated January 9 of this year. Mrs. Bailey says that every time she left the house and did not return at the time Mr. Bailey thought she should, he would accuse her of .being' out with other men. In his fits of anger, she says, he would tear curtains and pictures from their hangings and would destroy them. On September 3rd she left him for a short time but returned when he promised to quit coming home drunk and using such vile language. Mrs. Bailey asks for ?500 alimony and the restora? tlon of her maiden name, Emma Ha-berman.

ARBUCKLE FIGURING ON VINDICATION

McNab claimed t have a witness who "listened in" on this conversation held over the telephone. He also stated lie had advised the district attorney's office regarding Mrs. Brigg. The defense also lost no time in tearing into the finger print testimony offered by the state. They called as their first witness Adolph Juel, firger print expert of the San Francisco police department, who denied the contentions of the state witness, E. O. Heinrichs, that finger prints on the door of room 1219 of the hotel suite in which the A-r buckle party was held, could be identified as those of Arbuckle and Miss Rappe.

The defense in the third trial of the film comodian for manslaughter was well under way when court convened today. Defence counsel announced two weeks would be re quired to present the defendant's case. An attempt to show the evidence of Mrs. Virginia Brigg to be "spite evidence" was predicted. Mrs. Brigg, a hospitel secretary, who, caused a sensattion by testifying at the close of the state's case that Virginia Rappe had directly occused Arbuckle of responsibility for her condition on her death bed, admitted a conversation with -Gavin McNab. Arbuckle's leading attorney, in which she demanded payment of the Rappe girls' hospital bill.
