In a satisfactory and lawful manner, as well as for the purpose hereinbefore mentioned in connection with general sewerage and drainage; and WHEREAS, the said corporation, cognizant of the premises as hereinbefore set out, agrees that the Bald system of drainage or sewerage as referred to should be no constructed, installed, maintained and operated, and in view of all the said facts and the further consideration of having such system of drainage or sewerage constructed and Installed promptly, prop
erly and safely has, and by these pres ents does, agrees to so install and construct such sys.tem at its own expense, without delay, as soon as the indus trial development of the said ground as contemplated by both parties hereto, has progressed sufficiently to per mit, practically, efficiently and properly, the installation of such drainage or sewerage system from the said ground as thus developed. NOW. THEREFORE, it is agreed an understood by and between the parties hereto. (1) That the said system of drain age or sewerage shall be constructed, Installed, maintained and operated by the said corporat i.r., at its own ex pense, along and upon the following route In the said City of Hammond that is to say, along under and upon a tract of land owned by said first party. fifty (50) feet wide lying immediately west of and adjoining the west line of. AVhite Oak Avenue, in said City of Hammond, Stale of Indiana, and run ning in a southerly direction from the north line of 143d Street at Intersection with said AVhite Oak Avenue, along the west side of AA'hite Oak Ave nue to its intersection with 151st Street In the said City of Hammond, and continuing in a straight line to the Grand Calumet River, crossing and in tersectlng the streets and alleys here inafter mentioned, in said City of Ham mond; PROVIDED, HOWEVER, that the said City of Hammond hereby grants to said corporation, its successors and assigns, the right to deviate from the said route at a point between Hoffman Street and 150th Street, in said City and thence crossing AVhite Oak Avenue aforesaid, In a Southeasterly direction to the center of said Avenue, at that point connecting with the drainage or sewerage system which the said cor poration is authorized by the City of East Chicago to construct, install, maintain and operate from that point across other lands of said corporation to the Grand Calumet River, aforesaid and PROVIDED, FURTHER, if this last mentioned alternative route shall be adoped by the said corporation, then that portion of the first route herein above specified, which is thereby unused, may be abandoned by said corporation and thereupon said corporation shall be under no obligation to construct said drainage or sewerage system over that portion of said route so abandoned by said corporation. (2) That the said corporation further agrees to lay and at all times operate and maintain the said drainage or sewer system in such way as not to interfere with any drainage sewer or water pipe which may hereafter be located upon, along or across, the streets or alleys Intersecting the said route, nor to interfere with any of the said drainage sewer or water pipes wh'ch are, or may hereafter be constructed along, over, or across said route by said City, or by any other person or corporation, or by the Government of the United States. (3) That the said corporation further agrees that if at any time in the laying or construction of any sewers, drains or water pipes, the said sewer system shall be found to interfere with the same, then the first party, Its successors and assigns, will cause the said sewer system to be raised or lowered, as expeditiously as possible as the said City may demand, upon thirty (30) days' notice in writing by said second party to said first party, as said second party may demand. (4 That the said corporation further agrees that when said sewer system shall be constructed and in operation there rhall be permitted the connection therewith and the use and advantages thereof by the owners of the real prop erty abutting upon said sewer, or White Oak Avenue In said City of Hammond, Indiana, in the samemanner. method and form and to the same extent in all things as they might or could do in connection with the use or enjoyment by them of any other drainage or sewerage system in the said City of Hammond, and upon such terms and conditions as to the construction of such connections as may be ordered and deemed proper by said second party by and thru Its then Board of Public Works. (5) That the said corporation fur ther agrees that It, Its successors and assigns will forever maintain the said sewer system In such a way as may be reasonable and proper, making good at its own expense, all damage which may be caused to the surface of the land on account of the construction, maintenance and repair of said sewer. (6) That the said corporation further agrees that It will construct said sewer system of reinforced concrete or equally as goocl material, and the same Is to be not less than three (3) feet underneath the streets and alleys hereinafter mentioned. (7) That the said corporation further agrees that said sewer system shall not exceed, on the Inside cross section, twenty-five (25) feet in width, by - twelve (12) feet in height, or a structure of equal cross sectional area. (9) That the easement, right, authorization and permission granted, given and conveyed by the said City of Hammond to the said corporation by subparagraph (S), above, shall Inure to the benefit of the said corporation, the said East Chicago Company as the owner of the said property hereinbefore described, and to its grantee or grantees, successors find assigns. (10) That before proceeding with the installation or construction of the said drainage or sewer system, as hereinbefore, provided, the said corporation or its grantee, successor or assignee shall procure and file with the City Clerk of the eaid City of Hammond, after approval by the Mayor thereof, a bond, upon good and sufficient surety. In the penal sum of Twenty-five Thousand ($25,000.00) Dollars to the said City of Hammond, Indemnifying and saying harmless the said City of Hammond from and a&ainst any and all liabilities claimed or alleged against It arising from and by reason of any and all damages caused by the constructon, installation, operation or maintenance of the said drainage or sewerage system.
