ed in Hammond. He Insisted ha never gained a residence In lake county although evidence wa introduced to show that he had lived in Gary long enough. Before the suit wu tried Mrs. rostal persuaded him to withdraw it. He says be instructed his attorneys to do so and also informed Judge Hardy that they would take Buch action. The suit was rot dismissed, but after Postal had left Hammond, his wife ume and obtained a default decree on her cross-complaint. She was given the custody o the children. 21,50O .liniony and $1,000 attorney fees. The juds:Bant was rendered October 18, 19H. In the fall of 1919 Postal, having learned of tho divorce, returned to Hammond and asked that the judgment be set aside 'Ki the ground that it waa obtained through fraud. He insisted that neither party was a resident of the county. Tho matter was transferred to Judge Keiter in Room 1 and the hearing required several weeks. All of Postal's travels and activities durii.g the lafct ten years were gone Into minutely. Some of his affairs brought gaapa of surprise from court ppoctators. It was learned incidentally that he had even taken over German property during the war to dispose of privately in order that it might not be seized by the government. This was only touched on lightly. The attorneys for iirs. Postal finally broufcht the hearing to a close by moving that the court prepare special findings of facts and conclusions of law. Judge Keiter took the matter under ad vleiueut and worked on it nearly six months. He submitted his findings on June 2, holding that the origlnai decree, granted by Judge Hardy was valid and that the decree should not be set aside, modiiied or changed. The Plaintil liled his appeal bond on June 2S. Yetfterday the supreme court held that the parties of the suit were not residents of LmUh countj- for si mouths and hence the Hammond courts did not have jurisdiction to render the dacree which was held void. Tho Postals are still married. The plaintiff was represented by the late Judge Gillett. of Hammond. and Kichhorn and Hamilton of Bluffton, while the defendant was represented
