Reppa selects George Lupean for the duel and files eult for $10,000 against Lai pea n. charging that an affidavit mads by the latter Is false and slanderous. At a preliminary hearing (Saturday) Lupean testifies to the genuineness of the affidavit and stands on his conatltutlonaJ rights. The second auction was taken yesterday. Repoa, the lender, faced Lupean, the borrower. In a room at the- courthouse. Attorney C. B. Tlnkham represented Reppa and Attorney W. J. McAleer appeared for Lupean. per month for twenty-four months, a total of 480.00. I never was late with my payments or delinquent In
payment. After I paid the $480 I aked to have the balance due stated to me as I wished to pay It oft and Reppa told mo I owed Just $800. I borrowed
$8u0 of a Riley bank and paid Mr. Reppa the $800. When I paid off the notes each month, four In number, I
saw Mr. Reppa tear the stamps off and put them In the drawer of the table. I

April 29 and $80 and $50, May 1919 which were also paid.
In summing up the evidence. Attorney W. J. McAleer said that he was not satisfied with the explanation Mr.

loaned the money to Lupean and the latter had paid It back. Reppa made the loans as secretary of a building and loan association.
