She signed an agreement and put up $500. Later she learned that her attorney had included a piece of Indiana Harbor property in the deal which she had not intended. She protested and wag informed that for $200 Borowski could be induced to sign a release. She paid the ?200. Its section prohibitms: the operation of vehicles for hire on that part of Hroadwty north of Third ave. This morning in the Hammond supericr court Attorney J. H. ilonroy filed a complaint for a temporary injunction egainft the city of Gary tj prev .-nt the enforcement of the ordinance, the plaintlff being John Volk. Mr. Yolk his started the actionon behalf of himself nd eighty-three other members of Ival 423 f the chauffeurs union. Section 3 of the traffic ordinance forbids tha operation of vehicles carri:iipassengers for hire with the exception of street cars in flopping. solictiiit-. taking e-n or discharging' passenttirs on he part of the street specified. Hardy in Room 2 this ir.orninp audi Attorney Conroy explained the stand of the jitney drivers. Ha holds that the r'ction of the ordinance J? unconstitutional in that it is prohibitive instead of merely regulating traffic as it purports. He says tha street has newr been designated as a boulevard on v. hion I only certain classes of vehicles might be permitted. It is further contended that the city has no right to prohibit certain classes of traffics over such a street. Su h power would rest with the state nd as yet the legislature of Indiana has not exercised this power. It was pointed vjt that an attempt was made to pass a law fit the last session of the legislature delegating such, power to the cities, but the bill was defeated. Attorney Conroy did not ask for a temporary restraining order without notice, as he believed that the jitney drivers would nut be interfered w.th after the notice cf the application for a temporary injunction had been served upon the cflteials of Gary. Judge Hardy set the' matter for hearing next Thursday morning at 10 o'clock. At that time the plaintiffs will endeavor to'bhow the court that the section of tne ordinance is unconstitutional and should be held invalid. The chauffeurs are in the fight to the finish and have had Attorney Conroy working on the case since the ordinance be. arne effective the middle of August. AUTO mis D. W. GRAPE While standing on the street r.ear the corner of Kighth ave. and Broadway in ;ary Saturday evening, P. VT. Grape, 520 Buchanon et., had a narrow escape from serious injury when he was struck by a piece of the protruding top of a passing automobile and dragged a distance of nearly fifteen feet. After his coat fiad been torn to shreds he was able to free himself. Children in the rear of the machine r-orenmed and Asked the driver of the car to stop, but ha only turned on more juice and made an attempt to escape. Grape, however, was able to ?r-nir the license number of the machine and unless the owner of tho car makes himself known and causes an immediate settlement for his damaged clothes, he will cause his arrest. MILK DRIVERS TO ASK MORE PAY Demands for increases in wastes will be made by the owners of milk depots in Gary the 15th of this month, was the decision reached by the Milk drivers' association at a meeting in the labor headquarters last week. The scale that was unanimously adopted is as follows: $33 a week and 3 per cent commission, unexperienced drivers $30 a week and 3 per cent commission.
