SECTION II The rights, privileges ar.d franchise nereby granted shall exist from the date this contract end grant becomes effective, until March 1st. A D. 1954. such being the date of the expiration of
the term of the Grantee's present franchise granted by the Mayor and Common Council of the City of Hammond to the Grantee, Its successors and nisigns. on the 1st day of March, A. D. 190-1. and the supplemental franchise granted by the Mayor and Common Council of said City to the Grantee on the 6th day of February. A. D. 1907. SECTION III. The Grantee may lay in either of the streets hereby granted, either a single or double track electric railway, or may first lay a single track ajd afterwards a doublo track, in Its discretion. A slnKle tiack in said streets connecting uith the present tracks of the Grantee mid the Gary Street Railway Company as provided in Section I. of this contract, shall be built and in operation within six months after this contract Sues into effect, provided that the time in which the Grantee is prevented from prosecuting the work of construction or operation or both, by reason of strikes, riots. Inclement weajher. the act of God, injunction or legal process shall not be computed In arriving at said period of six months. SECTION IV. Consent and au'hority is also given the Grantee, its successors And assigns, to construct, maintain and operate from I he date this contract becomes effective, until its termination, a double wye curve conro-oiion from its present tracks on Hohman Street, to, upon and connecting with the present tracks of the Gary Street Railway Company where the same terminate at Hohman and Sibley Streets in aid City, together with all necessary poi- s, cross, feed and trolley wires, overhead construction and special work necessury to maj;e an adequate double curve connection for the operation of the Grantee's cars to and oxer the tracks of the tiary Street Railway Company on Sibley Street, and the operation of the cars of the Gary Street Railway Company upon the Grantee's tracks upon Hohman Street as hereinafter provided. SECTION V.
The Grantee agrees that It will permit the Gary Street Railway Company to j operate Its cars and power over the ' r.icks of the Grantee now laid and to be built tinder this contract, upon the following streets in aali City, On Hohman Street from Sibley Street to State Street; on State Street from Hohmna Street to Calumet Avenue; on Calumet Avenue from State Street to Sibley Street. on condition that It. the Grantee. Is granted li.te permission by the Gary Street Railay Company to operate its. the Grantee's cars, upon the tracks of th said Gary Street Railay Company in Sibley Street, from l!)hman Street 'o Stale Street; on S:ate Street from Sibley Street to Summer Street, and on Summer Street from State Street to I tun Avenue. And the Grantee agrees t h t it will, as soott as practicable, after this agreement becomes tffective. enter in'o a-i agreement with said Gary Street Railway Company, for the mutual operation of the cars of the Grantee and said Gary Street Railway Company upon Bfd over the streets provide for in this Section of this contract,, upon such terms as shall be mutually agreed upon between the Grantee and said Gary Street Railway Company. Said contract with said Gary Street Railway Company shall provide, and the Grantee agrees, that while said joint operating agreement is in effect, the cars of both Companies shall be so routed as to rrovide a loop service over the respective traclfs of both Companies on State Street and Sibley Street, between Hohman Street and Calumet Aver. tie; that all westbound cars of said Gary Street Railway Company entering the City of Hammond, hall run north on Calumet Avenue from Sibley Street to State Street: thenco west on State Sfreet to Hohman Street; thence south on Hohman Street to Sibley Street; and ih'U .all eastbound cars of said Gary Street Railway Company shall run on Sibley Street from Hohman Street to Calumet Avenue in an easterly direction. And that all the cars of the Grantee traveling upon State Street and S.bley Street between Hohman Street and Calumet Avenue shall have the same routing as the cars of said Gary Street Railway Company around said loop. that is. all westbound cars of the Grantee upon State Street shall proceed exclusively in a westerly direction from Calumet Avenue to Hohm.in Street, and all of tiie Grantee's cars traveling on Sibley Street shall proceed exclusively in an easterly direction from Hohman Street to Calumet Avenue. And for the purpose of enabling the Grantee to operate Its cars upon and over said tracks of said Gary Street Railawy Company, the Grantee is given the right, franchise and privilege, if the! Grantee shall first enter into a contract with said Gary Street Railway Company for the mutual operation of the cars of said Companies as in this Section provided, to construct, equip and maintain on both sides of Sibley Street from Hohman Street to State Street; State Street from Sibley- Street to Summer S'reet. and Summer Street from State Street to Perm Avenue, all necessary poles un.l cross, feed and trolley wires and overhead construction to enable-it to operate its cars and power over the tracks of said Gary Street Railway Company, upon and over said streets to said Perm Avenue. And the City of Hammond hereby gives its consent to the mutual operation of the cars of the Grantee and said Gary Street Railway Company upon the tracks of each of said Companies, and upon such terms and conditions as shall be mutually agreed upon by said Companies as in this Section provided. SECTION VI. The Grantee tdial! be liable for and eave the City harmless from all damages which it may sustain by reason of Injury to any persons or property through the carelessness or negligence or want of ordinary care of any agent or servant or other employe of said Grantee in the course of their employment during the construction period or in the operation of said railway. But the Grantee shall not be liable to the Grantor for damages which It may sustain by reason of injury to any persons or property through he carelessness or negligence of the Gary Street Railway Company or any of its servants or employes in the course of the operation by said Gary Street Railway Company of its cars upon the track or tracks of the Grantee as provided in Section V. of this contract. SECTION VII When tho Grantee nhall have constructed a single track line on Columbia Avenue from Morton Avenue to the track of the Gary Street Railway Company at Sibley Street, and on Calumet Avenue from its present track at State Street to the track of said Gary Street Railway Company at Sjibley Street, and the curve connection between the Grantee's tracks and the tracks of the GaryStreet Railway Company at Hohman and Sibley Streets, as in this contract provided, and shall have said track on Columbia Avenue in operation under a regular schedule for operating cars, and when the Grantee and said Gary Street Railway Company shall have their cars in operation jointly upon the Grantee's tracks on Calumet Avenue from Sibley Street o State Street; on State Street from Calumet Avenue to Hohman Street; oh Hohman Street from State Street to
Sibley Street, and on the track of the Gary Street Railway Company on Sihlev Street from Hohman Street U Cnlurnb.a Avenue under a regular schedule for Hie. operation of such cars of both Companies, then the Grantee shall be relieved and absolved from the duty of construcflng a second or double track and the pavement for double track on State Street from Hohman Street to Cnlumet Avenue, as provided in Section 2 of the Franchise Ordinance granted by the Grantor to the Grantee March 1st. A. D. 1904. and under which it is now operating Its line of track in State Street. If at any time in the future, the Grantee shall cease to operate Its ears Jointly with said Gary Street Railway Company, around the loop on Calumet Avenue from Sibley Street to State Street; on State Street from Calumet Avenue to Hohman Street; on Hohman Street from State Street to Sibley Street, and on Sibley Street from Hohman Street to Calumet Avenue, as in Section V. of this contract provided, then it. the Grantee, shall be required to lay an additional or second track on State Street from Hohman Street to Calumet Avenue, and pave said street and keep the same in repair for double tracks, at he time and in the manner and subject to the conditions provided in Section 2 of said Franchise Ordinace granted by the Grantor to the Grantee March 1st, A. D. 1904. If. between the time this contract becomes effective, and such time in the future as the Grantee and said GaryStreet Railway Company shall cease to operate their cars jointly around said loop as said in Section V. of this contract provided, the City of Hammond shall pave said State Stret between Hohman Street and Calumet Avenue, then and in such event, when it reuses to operate its cars around said loop Jointly with the cars of said Gary Street Railway Company, the Grantee shall pay to the City of Hammond, an amount of money equal to the cost price of a rip of said pavement, eight ( fi ) feet wide on State Street between said Hohman Street and said Calumet Avenue, figured per lineal yard upon the cost of Bald entire pavement, as determined by the contract with said City under which the said pavement is laid. SECTION VIII. All track, poles, wire and overhead construction shall be erected and maintained under the supervision o the Board of Public Works of the Grantor. The Grantee shall make no excavations In or under the surface of any street or alley covered by this grant, in violation of any ordinance, of said Cay. nor until it has first obtained a permit for such excavation from said Board of Public AVorks. The Grantee agrees in all cases where it has disturbed the surface of any street or alley, or made any excavations under any street or alley covered by this grant, to restore said street or alley to its original condition, to the satisfaction of said Board of Public Works, and upon its failure so to do, the said City shall have the right to restore said street or alley to its said original condition, and the reasonable cost of such work shall be paid by the Grantee to said City. SECTION IX. The provisions of this contract are solely for the extension of the lines ol street railway now operated by the Grantee upon the streets of the Grantor, and for the construction of curves and connections between the tracks of the Grantee end the Gary Street Railway Company, and the Joint and mutual operation by the Grantee and said GaryStreet Railway Company of their tracks upon certain streets ol said City hereinbefore provided, and this contract and grant carries with it ail the rights and privileges now enjoyed by the Grantee, and Is subject to all the conditions and restrictions at present governing the Grantee In the construction, operation and maintenance of its lines of street-railway In said City, as embodied in a csrtain Franchise Ordinance granted by the Mayor and Common Council of the Grantor to the Grantee, its successors and assigns on the 1st day of March. A. D. 1904, and the Franchise Ordinance supplemental thereto granted by the Mayor and Common Council of the Grantor to the Grantee on the 5th day of February, A. D. 1907.
