Valparaiso, Ind., Nov. 15. The case of Archovie against Prasciak, which occupied three days of Judge Batholomew's time, was decided yesterday for the defendant. Archovie had a contract for the purchase of some Gary property and. after signifying his intention of not taking advantage of it. I'rasciak disposed of it to another party according to the findings of the court.

Chicago, Nov. 15. Henry Spencer, confessed slayer of Mrs. Mildred Allison Rexroat, the "tanpo" dancing teacher, was last night found guilty of murder by a jury at Wheaton, a suburb. The death penalty was fixed by the Jury, which returned a verdict after little more than two hours' deliberation. The first ballot was 11 to 1 for
the death penalty and the second bal lot was unanimously in favor of send ing Spencer to the gallows. Spencer was arrested October 5, ac
cused of having lured Mrs. Rexroat to
Wayne, 111., and placing her body on
the railroad track, after he had shot
her to death. Mrs. Rexroat's body was
found early in the morning of Septem
ber 27.

were surveyed by the government engineers one gang started at a mi ridian line in Indiana and blocked out the section squares toward th? Indiana? Illinois state line. Surveying is not an exact science, liy the time they got to the line their survey lapped over the already fixed state line and extended into Illinois. What Illinois Surveyor Did. 3. Then the Illinois surveyors started out from their principal meridian line and surveyed eastward. When they arrived at the state line their survey lapped over Into Indiana. 4. In the case of ' neither the Indiana or the Illinois survey did the surveyors tie up the corner on the state line. Their reason was that it was not necessary. The state line was already positively determined. That formed the western or eastern boundary of the section as the case might be. This is the situation that this surveyor took advantage of in his effort to cloud the issues and hide the theft of the street that was being1 carried on under his very eyes. So one after another the owners 'of State Lino street lota encroached on the street with their buildings until today it would cost ten or fifteen thousand dollars to rectify the willful seizure of land that was made under the pretense that one one could tell where the state line lay. "We can afford no longer delay," the executive said. City Attorney John Oavit of Hammond supported the mayor in his statement. "West Hammond hasn't done anything yet, and they won't." he said. "Hammond will go right ahead." Telephone C'alln Galore. Thb Times was called to answer questions and listen to opinions repeatedly today. City Clerk Mankowski telephoned the official announcement from across the line: "We can enjoin every Inch of Hammond's improvement," he said. "If the surrey isn't rectified we will. It takes a lot of nerve to add five feet of somebody else's property to yours, but that is what Hammond did when It widened State Lineslreet. Now they have as high as thirty-five feet of Illinois ground in one place and we want it back. "Lyons calls me Incompetent, but he Is the most incompetent man :I know In public office. He established a line and ordered the board of public works to go ahead. It was a city Job and he can't blame the county. It was up to him to protect the people of Hammond.
