"Honest Abe," therefore at least by Implication, took the stand that It was "unfair" for the Citizens Party to have two members on the board but that It was simply a matter of equity and unquestioned fairness for the Republicans to have two Schlieker men on the board. Attorney Glazebrook of the Harbor went even further and said that the attitude of the Republicans in these legal proceedings manifestly was not only to name two members of this board but to actually and unquestionably to name the whole three members. He disclosed their plans by calling attention to the fact that Spencer was a Schlieker Republican and that he was a member of the board by virtue of his office as city clerk; that the Republicans were trying to mandate the apDON'T GO TO LAW Our Abstract will show you whether yor are buying land or a law suit. real cause of action in the case and consequently denied the motion. I It then became evident that the Republicans had another card to play. I Thus far, it had been hid high up (heir sleeve. An affidavit was filed asking for a change of venue outside the county. The Judge acted at once upon the affidavit and sent the case to Judge Bartholomew at Valparaiso, in . Porter county. i This is one of the delays that is inI evitable to the administration of justice under the law whenever the pro- ' per affidavit Is filed. The judge issued an order, however, that the trans cript be made instanter and forwarded at once. It will probably come up for hearing within a very few days, i Attorney Walter L. Lotz presented in the main the argument for the would-be interpleaders and was assisted by Attorneys Kennedy, Glarebrook and Roe. On the other side of the question were Attorneys L. V. Cravens, Peter Crumpacker, Abe Ottenhelmer, W. B. Van Home and Joe Meade. Attorneys for the progressives, argued that the case at bar was one involving a public matter, ad that not much more time can be lost in courts as the inspectors would have to be appointed soon, by the city clerk who In this case happens to be Walter L. Spencer a republican. In discussing the case from the bench Judge Reiter said that should the parties petitioning as interpleaders be admitted, It would put the court in a position to rule on a matter which is to be determned by another court. Attorney Roe then to press further his cause argued that the mandamus proceeding brought by a republican organization against a republican city clerk took on the nature of an exparte proceedure, in the language of the street a cut and dried affair. Judge Reiter apparently resented the position taken by Roe and informed him that there was no occasion for any Insinuation or statement In which Attorney Roe sincerely concurred. At this point the noon recess was taken. LJdk Tvew'Doulle
