Baxter claimed no interest in it.

Judge Relter decided that Harrisa had

no interest in it because it had been secured by Komornickl on a forged

for the bankrupt had no right to it.

This established the title of the See

This decision does not. however.

affect the 15 pianos which Komornickl

really had title to and which Surprise

sold at a receiver's sale. The Seeburg

nal $500 license fee ordinance Is taint

ed with fraud and. that the taint has not been cleared away' I decided to approve the reoealing ordinance. 'I do not believe it is right that the people or any portion of the people of Gary

should be taxed by means of an ordinance the passage of which has been procured by fraud and bribery; especially when the effect of the ordinance so passed is to shift the burden of taxation from one business Interest to another. And He Favora the Repeal. " 'Therefore, in view of the fact that charges have been made that the passage of the original high license ordinance was accomplished by fraud and

bribery, and from the further fact that such charges have not been specifically denied or satisfactorily explained and although I am sincerely in favor of a higher license than $200 a year, I am nevertheless Impelled by a due sense of honesty and justice to give my assent to an ordinance repealing a measure bearing upon its face the sinister stain of fraud nnd corruption.'"

before the appointments are announced. This will assure the full cooperation of the courts and the association in the elimination of undesirables. President Moran made the statement that In Hammond and especially. He said that most of these attorneys are now outside of the association but that there are a few of them who are now members. There are a number of attorneys who confine their practice to the ignorant class for foreigners in this county and they make a living by preying on them. OWNERSHIP QUESTION SADLY

' INVOLVED

rContlnued from Page J.)

May and he was adjudged a bankrupt

Oct. 10, after he had made a hard fight

to prevent it.

The pianos were then turned over to Charles Surprise Who was appointed

trustee to receive the property. Surprise was elected trustee on Nov. 7

and 47 pianos were turned over to him

by Attorney J. Glenn Harris.

A little later the Seeburg Piano Co. and James Rough started proceedings

to replevin the pianos, that is 27 of them. . Judge Reiter was asked, in a test case, to decide whether one of the

pianos belonged to Lewis Baxter, a sa

loon keeper who had it la tis place, J.

H. G. Hay, Jr., president of the Gary state bank, was in conference with his attorney Judge Greenlee this morning and he said that some time today he will answer .Mayor Knotta' statement published in the Gary Post last night wherein he gives his reasons for signing the liquor license repeal ordinance. The mayor involves Hay's name in his statement and recounts the bribery charges made by Alderman Castleman

who accused Hay of buying the vote

of former Alderman Baukus to secure the pasage of the good government measure. Knotts states that inasmuch as Hay has not refuted the bribery accustatlon that he signs the repeal ordi

nance, a god-send to the breweries and saloon men, a measure which reduces

licenses fees from $500 to 1200.

The statement published in the Post

follows: - Kantta' Statement Ta Fall.

"I think it but just and proper that the people of Gary should know my

reasons for signing the ordinance re

pealing the 9500 liquor license measure passed by the council last year and

in making that statement I Bhall be as concise as possible. "I very much regret that circumstances surrounding the passage of tha

original liquor license ordinance which

was repealed by the passage of the one

I signed yesterday, has compelled me to sign the measure for its repeal. I

was in favor of a high license when the $500 license measure was adopted by

the city council and I am still in favor

of a higher license than $200 a year. I

am fully aware of the fact that the re

peal of the $500 license fee and the return to the $200 fee will result in a

loss to the city revenues of more than

$30,000 annually and that this falling

off in saloon revenues will have to be

made up in some other manner, but I also am fully aware that an ordinance passed by fraud ought not to be allowed to stand on the book of ordinances of the city of Gary. He Recall Caatlesnaa'a Charge. ' 'When Councilman Caatleman intro

duced the repealing ordinance, ha ac

companied it by an open and positive statement, made on the floor , of the council chamber that the passage wf the original liquor license ordinance the one it was sought to repeal had been brought about by means of bribery and fraud. It wa stated on the floor of the council chamber that H. G. Hay, Jr., of this city, was the person who offered the bribe and that the offer was made to Anthony Baukus, then a member of the council. It was also charged that the ordinance would not have passed had it not been for thi vote of Councilman Baukus and othe.r members whose votes had been Influenced. BUI, Cain (io Between f " 'Ten days have elapsed since those charges were made in the council chamber, yet there has been no specific denial of the charges made by the author of the repealin gordlnance, he only explanation offered by Mr. Hay is that, through William A. Cain. I solicited him Mr. Hay to go to Councilman Baukus and endeavor to secure his vote in favor of the high. license ordinance. I emphatically deny that I ever asked Mr. Cain to see Mr. Hay In regard to soliciting Councilman Baukus to vote for the ordinance and Mr. Cain Says he does not remember any such circumstance. Mr. Hay has made no denial of the charge that he

offered Inducements to" Anthony Bauku for the later's -vote In favor of a high license, while on the other hand Councilman Castleman declares he has the positive proofs that such induce

ments were offered. What Did They Sayf "'I did have one conversation with Mr. Hay on the subject of the high license ordinance, which - also had to

do with Councilman Baukus, I have a very distinct recollection of the con

versation which actually took place between Mr. Hay and myself, but I will

not now disclose its nature, since I

may be called upon to make the dis

closure In a court room. Then I shall

tell Just what was said in that conversation; what Mr. Hay said and also tell when and where the conversation took place. 'In view ol the fact that the orisl-
