In view of the fact that there are many suits involving th'e possession of tenancy to property, some excerpts from the decision ot Judge Tuthill will be of interest. , ' The cour,t holds, "Entirely independent of Boney's rights as a hold-over tenant or sub-lessee of Tayyer, the
fact remains that he was in peaceable possession of the premises at the time of the ouster. He was a tenant at suf-
france. He Is one who conies in by
right and holds over without right. He holds without right and yet he is Jtot a trespasser." ) . Then follows certain statements of fact as were brought out in the trial which tend to show that Tapper took forcible possession of the premises. Took Wrong Procedure. The court's opinoin states, "The statute of forcible entry and detainer takes away the owner's common law right to forcibly enter upon his tenant , hold
ing over after the termination of the tenancy. ' After reviewing some of the other facts in the case the court holds, "The conclusion is hence Irresistible that his possession was ousted by writ of injunction and not under the procedure for the removal of a hold-over tenant, which procedure is the only course provided by Indiana law." The following is probably the most signiQcant statement in the opinoin, "While for many years the common law
right of forcible entry by the landlord
and the maintenance of that possession was sustained by the American
covtrts, the pendulum has swung about
n the other direction; and now it may
beaid to be overwhelmingly against such procedure."
A formal entry of the judgment of
the court will be made on Thursday.

XMAS MONEY
Evelyn Wilkening. .
An effort to confirm these facts was
made by calling Barnie Kulczyk upon
the telephone. Kulcxyk in answer to the
same questions stated that the mother's
name was Lillie Wilkening, the fa
ther's name Carl Wilkening, the child's
name Evelyn Wilkening.
On thf face of it these reports did
not correspond. Kulczyk claimed that the report gave the mother's name as Lillie Wilkening and Mrs. Gehrke'e re
port gate, the mother's name as Lillie
Schmidt.
To make sure of the facts Kulczyk
was called up on the telephone the second time. In answer to the question. "Is the name of the mother given
as Lillie Wilkening?" he replied In the affirmative.
Then Mrs. Gehrke called up again
and her seeming reluctance to have an
Investigation made of the records at Chicago indicated that she did not
want the real facts known.
It develops that this assumption was
not founded in fact, for the records
This Times regrets that she has been made the victim of the biunder of the West Hammond health officer. It Is true that Kulczyk called up after the paper had gone to press and stated that , he was wrong in his first statement, but that was only after Mrs. Gehrke had pointed out his blunder to him. Hammond doctors who have been Interviewed about Mrs. Gehrke's reputation as a practitioner of obstetrics say that her reputation, so far as they knew Is excellent. Regarding Mrs. G-ehrke's , alleged statement to the effect that. "All of the doctors In Hammond, ronceal the real facts In these cases. -" They make out their reports to suit their own convenience," she denies that she said this. She claims that she said that there are other cases like this (meaning like
that of the Schmidt girl) and no report

The communication wis referred to the committee for further consideration of the subject. - Saloon licenses were granted to Abe Goldsmith, John Hanish and Charles Musnlln. City Engineer Walte filed his report of the completion ot sidewalk in White Oak avenue. The city engineer also submitted his report of the completion of the improvement of the. White Oak avenue paving.
A resolution was adopted approving the report and ordering the preparation of the primary assessment roll. An ordinance was adopted appropriating money from the general fund into the special fund for 1912. It was decided to pay all city officials, except the mayor and council, their December salaries In advance. City Attorney J. E. Westfall was Instructed to prepare an ordinance condemning two buildings on 119th street. It was decided to appoint a committee consisting of Aldermen Duggan,
Burton and Paskwletz. to Inspect the Porter and Kessler building on the
north side of 119th street, between the Fort Wayne track and Center street, and also the skating rink on Indiana boulevard and that the committee be instructed to employ a competent me-

his record only the mother's maiden name appears ani that Is given as Lillie Schmidt.

the reason is- plain why he gave the
mother's name as Mrs. Lillian Wilken
ing. His report did not indicate "the fact-that Ihe-child' was illegitimate.
In Kulczvk's report book there Is
a line in which he is supposed to Indicate' the' fact" tha the child was Illegi
timate.; Instead of doing this he simply drew a line in the space reserved for that particular information. His report in this case was no different than that of a number of legitimate births. So the responsibility for the misstatement must be placed on Kulczyk. Had he made his records complete he would have known that the child was illegitimate and would have said so when he was twice asked for the facts In the case. Mrs. Gehrke Is absolved of any charges of falsifying the records, and
This matter Is one in which Mrs.
Gehrke evidently said one thing' and meant another or else she said one thing and the reporter understood -an-onther. The conversation was over the telephone and that possibly accounts for the misunderstanding of what Mrs. Gehrke really said.
