(Special to The Times.) Valparaiso, Ind., June 9. The defense In the Gary election cases, which are on trial before Special Judge Charles Hanly of this city, has revealed the nature of its defense. The riotous conduct which disgraced Gary at th last gre-neral election was due to the fact that Thomas Grant and Chief of Police Joseph D. Martin were such heated rivals. The theory of the defense is that when a contest for a political office becomes heated that very fact ought to excuse Infractions of the law, assaults and alleged attempts at murder.
It is on this theory that the defense is going about Its task of clearing "Dog Face Charley," an imported tnjg, and a number of the othr defendants In these cases. Another very Interesting and Illuminating statement is that It wa

The first witness was Edward Hall, a
Gary attorney, and the other Is Lt W.
McNamee, the auditor of the company.
McNamee has been on the stand since yesterday afternoon and his testimony
will not be completed for several days.

tem that is employed by the Indiana
Steel Co. for the prevention of fraud.
It is necessary for the Jurors to have
an intimate knowledge of this system before they 'can understand how the alleged conspirators succeeded In beat
ing it. The state declares that It has Its best case against John Caldwell, the last of the defendants to be tried. The defense, however, is confident that it will be able to clear Caldwell. The ease promises to be a long drawn out affair and It is believed that it will not be completed before the end of the present term of court. One of the principal questions which came up yesterday Involved the admission of certain checks as exhibits in the case. The defense objected but the objections were overruled.

ALARM OF FIRE.

Fire broke out in Matt Harris' house. 150th and Magoun avenue, night before last, and while the blaze occasioned some little excitement In the neighborhood, it was extinguished with practically no loss. An alarm was turned in, however, and brought out the fire department.
