During the time mentioned in this proclamation any animal of the dog kind which may be found running at large within the City of Hammond without being muzzled is declared to be a nuisance by Ordinance No. 791, approved June 4th. 1908. On the strength of the evidence Judge Fetterhoff fined him two dollars and costs, with the privilege of taking ten days to pay it. during which time he may take an appeal If he so desires. Kirby pleaded not guilty, and In his eloquent appeal for Justice spared no opportunity to "roast" the police officers who caused his arrest. It is altogether ykely that Klrby will take an appeal for he was busy yesterday getting signatures of men who could testify that he never Indulged in the use of chewing tobacco or tobacco in any other form. Kirby has lived In Whiting for a number of years and has always stood for the rigid enforcement of laws and has been a perfectly straight and upright citizen, and for this reason his arrest has caused all the more surprise, the majority saying "there certain--must be some mistake." Waywood and Kirby were formerly next door neighbors, but when Henry Schrage started his new bank building at New York avenue and 119th street, the building in which Kirby had his tailor shop was moved to New York.
