franchise would be modified after It
had been taken from the council", hands. Melton. Resignation. Both Messrs. Melton and Nyhoft stated this morning that In their opinion the franchis. was Illegal. The reason for this lies in Mr. Melton', resignation. On Mareh 22nd Mr. Melton gave
a written notice to the mayor of his'
resignation as city engineer. For th
time, being his resignation was not ac
cepted. On April 30th. ho notified the
mayor, clerk and treasurer that he was

net day the franchise contract was passed by the board of public works. It was upon the request of Mayor Knotts that Mr. Melton made th motion for the passage of the franchise, with the understanding It was to be returned to the board of public works for
modification. Mr. Nyhoff seconded thai motion and both believe that owing to J the fact of Mr. Melton's resignation he was not a member of the board of pub-
